The HJC reacts to Rama's criticism of the judge: Such statements violate
Edi Rama / HJC

The High Judicial Council reacted this Thursday regarding the statements made a few days ago by Prime Minister Edi Rama to the judges on the decisions taken by them on issues related to public and private spaces.

The reaction comes a few days after the head of government wrote a status where he criticized judge Ligoraq Toshi, who according to him had not kept the interest of the community regarding a decision.

The HJC in its statement says that reactions that violate the image and dignity of judges hinder the independence of the judiciary. The HJC says the way to challenge the decisions is the legal route and not public statements.

Full statement:

The High Judicial Council, triggered by the recent statements of public or private entities, reiterates once again that such statements violate the image and dignity of judges as well as undermine the independence of the judiciary.

In any democratic society, judges are guarantors of the equality of the parties before the law. Therefore, the exercise of their function must be independent and free from any form of influence, subject only to the Constitution and laws. In a state of law, the separation and balancing of powers is a fundamental principle and the judge exercises his functions independently, evaluating the facts and interpreting the law, free from any external influence.

The Council calls on all public and private entities to respect the independence of the judiciary as one of the foundations of the rule of law. The only way to challenge a court decision is through the procedural means provided by law, by appealing to a higher court. Also, any complaint or allegation regarding the conduct or integrity of a judge should be addressed to the relevant institutions.

The HJC, in accordance with its constitutional powers, expresses its full support to all judges and their daily efforts in protecting the rights of citizens and in the service of the public interest. It also encourages them to exercise their function, responsibly and independently of any external influence.

In a state governed by the rule of law, which today is closer than ever to the aspiration to become part of the European Union, only through an independent judicial system can equality before the law and effective justice, which deserves the trust of the public, be ensured.
