The Posaҫme Anti-Corruption and Organized Crime Structure published the charges based on which the Anti-Corruption and Organized Crime Court (GJKKO) on Saturday appointed the security measure, "obligation to present to the judicial police" and "ban on exit abroad through passport blocking" for former Prime Minister Sali Berisha. These measures came immediately after the prison arrest of his son-in--prison, Jamarber Malltezi, and the seizure of his assets. The prison arrest was also taken on Saturday against builder Fatmir Bekteshi.

Former Prime Minister Berisha and his son-in-law, Jamarbër Malltezi, are accused by the Anticorruption Establishment (SPAK) of passive corruption in cooperation. Malltezi is also charged with cleaning the products of the criminal offense in co-operation with builder Fatmir Bektashi.

The two arrests and the security measure "enforcement of the courts" and "ban on foreign exit" for former Prime Minister Sali Berisha are linked to the investigation into the privatization of the former Sports Complex "Partizani" in Tirana.

The official announcement of SPAK emphasizes that the former Prime Minister Berisha has created a reasonable suspicion, based on evidence that he "consumed the criminal act of passive corruption of high state officials or local elected officials" in cooperation with his son-in-law, Jamarber Malltezi. According to SPAK, the privatization of sports grounds and facilities was carried out, with the sole purpose of being taken over, changing the destination and used for material benefit by citizen Jamarbër Malltezi, who the citizen is suspected of having consumed the criminal offense in co-operation with former Prime Minister Berisha, exploiting his power and irregular benefits."

SPAK notes that former Prime Minister Berisha as persom under investigation has "an obligation to appear in the judicial police and is forbidden from going abroad."

In July this year, former Deputy Prime Minister Arben Ahmetaj escaped hours before SPAK was to seek prison arrest on charges of failing to declare or false declaration of property, passive corruption, money laundering and abuse of office.

Former Prime Minister Berisha dismisses charges

At an extraordinary press conference late Saturday, former Prime Minister Berisha rejected SPAK's accusations.

"The charges are brought without any basis and are genuine political attacks by Edi Rami. They come just as the opposition has launched the movement without return against the dictatorship, which Edi Rama is creating with the theft of votes and public assets. I am not afraid of arrest," Berisha stressed at the press conference.

He said that the movement of the MP in or out of the country cannot be affected without the approval of parliament.

Former Prime Minister Berisha did not sign the security measures against him, which judicial police officers brought to him at the DP headquarters.

Results of SPAK investigations since 2020

The investigation of SPAK for the legality of privatization of sports grounds of the "Partizan" sports complex lasted three years. In these grounds, owned by the Ministry of Defence, spread over an area of 26 thousand square meters, within two terms of the government of former Prime Minister Berisha, 2005-2013, a complex of residential towers and palaces was built.

Interior Minister Taulant Balla, former head of the Socialist Party (SP) parliamentary group in 2020, in her second term in office, addressed a criminal case over legal violations in the privatization of the former sports complex "Partzani." He accused former Prime Minister Berisha and his son-in-chief Jamarbër Malltezi as direct beneficiaries of the privatisation of the former sports complex "Partizani."

The criminal offense registered in 2020 is that of "cleaning up the products of criminal offense"

In May 2021, former Prime Minister Berisha was declared by the US State Department persona non grata for "acts of corruption that undermine democracy in Albania." In July 2022, he was declared persona non grata by the UK authorities for "clear links to organised crime groups, criminals and corruption."
