Sending electoral messages to citizens' mobile phones by political parties or candidates is illegal.

With this statement, the Commissioner for the Right to Information and Protection of Personal Data, Besnik Dervishi, has condemned the messages sent automatically to the citizens of Tirana by Meta-Berisha's candidate for the capital, Belind Këlliçi.

The commissioner has warned of penalties for all electoral subjects who have done or will continue to do such a thing.

Sending SMS is considered illegal processing of personal data and any electoral subject or economic operator will be penalized according to the legislation for the protection of personal data.

"In recent days, a mass sending of messages by an electoral subject to citizens through the mobile phone service was found.

This activity is considered illegal processing of personal data and is contrary to the provisions of law no. 9887/2008 "On the protection of personal data".

The Office of the Commissioner for the Right to Information and Protection of Personal Data has made available to political parties and every electoral subject, but also to the entire public, the Guide "On the processing of personal data in the context of election campaigns".

This document explains even more clearly the approach in relation to the legal processing of personal data. The Commissioner's office will investigate any case of violation of law no. 9887/2008 "On the protection of personal data" from any electoral subject or economic operator. The Commissioner's Office also calls on all electoral subjects to immediately stop any illegal processing of personal data ," the statement said.
