Alibeaj's appeal against the registration of the coalition "Bashke

The Administrative Court of Appeals will decide tomorrow, on March 30, regarding the lawsuit filed by the DP of Enkelejd Alibeaj, against the registration of the coalition "Bashke Fitomje" by the CEC.

A few days ago, Alibeaj appealed to KAS the CEC's decision to register the coalition "We win together" for the May 14 local elections. In the letter addressed to the Appeals and Sanctions Commission, he requests the annulment of this decision.

Alibeaj claims that they have committed serious legal violations by using the PD symbols, initials, and name.

At the Tirana Administrative Court of Appeal, on behalf of the Judicial Electoral College, case No. 7 Act, Date 27.03.2023 Registration, with:

PLAINTIFF: Democratic Party of Albania, represented by Indrit Sefa;

RESPONDENT: Central Election Commission (CEC).

OBJECT: Repeal of decision no. 31, dated 21.03.2023 of KAS "Regarding non-acceptance for review of appeal request no. 37, dated 21.03.2023 filed by the "Democratic Party of Albania".

Repeal of decision no. 178, dated 18.03.2023 of the State Commissioner of Elections "For the examination of the request for the registration of the coalition "Bashke Fitomje", (BF) for the elections for local government bodies on May 14, 2023".

Completion of the deficiencies by the applicant Freedom Party by amending the Coalition Agreement by removing the Democratic Party of Albania from reference in this document.

For your information, the State Election Commissioner, with Decision No. 178, dated 18.03.2023, subject of the above lawsuit, has decided:

"1. Registration of the "Together We Win" Coalition (PL - PDK - PBDNJ) "BF", as an electoral subject participating in the elections for local government bodies on May 14, 2023 with its member parties as follows: a) "Partia e Lirisa" (PL); b) "Christian Democratic Party of Albania" (PDK); Union Party for Human Rights (PBDNJ);
2. This decision enters into force immediately and is published on the official website of the Central Election Commission;
3. Against this decision, an appeal can be made to the Appeals and Sanctions Commission within 3 (three) days from its announcement".

On 28.03.2023, a public lottery was held to determine the composition of the Judicial Electoral College and, according to it, the judicial body consists of judges:

Sokol Ibi (Rapporteur);
2. Magnola Xhaxho (Member);
3. Edlira Petri (Member);
4. Esmeralda Xili (Member);
5. Alma Kolgjoka (Member).
With the Decision dated 28.03.2023 "On the appointment of the court session and the deadline for completing the defects of the claim" of the Judicial Electoral College, the date 30.03.2023, at 15:30, has been set for the conduct of the court session in the premises of the "Poli" building. of Justice", the conference hall of the General Assembly, at the address: "Ana Komnena" Street, Tirana.
