The clash between internationals and the majority for justice already seems to be frontal, regardless of the formal acceptance that the US and the EU make of the Special Commission for Justice established only with the votes of the majority.

"Accountability and transparency cannot be used by the majority to undermine the independence of justice institutions." This is the firm position of the ambassador of the European Union, Silvio Gonzato, who opposed Fatmir Xhafa as the socialist deputy was trying to motivate the need for legal intervention, through the anti-corruption commission.

Gonzato asked the majority not to affect the role of civil society in justice institutions, but suggested how to improve the selection of non-magistrates.

Violation of the independence of justice institutions is a red line that Albanian politics should not cross.

The head of the EU delegation in Tirana, Silvio Gonzato, made this clear to the head of the special commission, since Fatmir Xhafaj had tried to motivate the need for legal intervention in the name of accountability. 

"Independence in the decision-making of judges and prosecutors cannot be a straitjacket for not being judged for responsibility, accountability and transparency. This would be a big mistake" , said Xhafaj.

Gonzato asked to take the floor again, abandoning diplomatic language to leave no room for misinterpretation.

"Without independent justice institutions, there is no independent justice. Criteria such as accountability and transparency cannot be used at the cost of their independence, and I think there are internal mechanisms for justice institutions to increase these two qualities" , said Gonzato.

The President of the Integration Council revealed that the heads of the new judiciary have rejected the supercommission.

Xhafaj demands that the accountability of justice institutions be increased before politics in the Parliament, while the EU ambassador objected, pointing out that the balance and hierarchy of the reform would be violated. Gonzato asked not to misuse the Brussels reports to justify such goals.

"The institutions of justice, through reporting to the Assembly, which is a constitutional and legal obligation, fulfill a part of this obligation that they have, but I believe that it is insufficient. I believe that together with the institutions of justice, civil society, we will have to look at mechanisms on how we can strengthen the mechanisms recognized by the constitution and the law and how we can add new mechanisms that are in function of responsibility, accountability and transparency", he said . says Xhafaj.

“Unë e di që në Raportin tonë të Progresit ose Raportin e Shqyrtimit të Legjislacionit, flasim për Parlamentin që të ushtrojë rolin e tij në mënyrë më adekuate, por kjo nuk ishte menduar të formulohej si ndryshim i kontrolleve dhe balancave aktuale ose ndryshimi i hierarkisë midis institucioneve të ndryshme. Ato synojnë thjesht të inkurajojnë Parlamentin që të ndjekë seriozisht ato diskutime që ai ka rregullisht me institucionet e pavarura të drejtësisë dhe institucione të tjera, dhe të ndjekë rekomandimet e bëra në raportet e këtyre institucioneve, duke marrë masat që nevojiten, duke përfshirë edhe masat buxhetore”, deklaroi ambasadori.

Përballë pakënaqësisë së mazhorancës me njerëzit që vijnë nga shoqëria civile në dy institucionet që qeverisin gjyqësorin dhe prokurorinë, si KLGJ dhe KLP, ambasadori i BE bëri të qartë se bëhet fjalë për një aspekt të rëndësishëm të reformës që nuk mund të cenohet, por sugjeroi gjithashtu një zgjidhje.

“Roli i shoqërisë civile në sistemin e ri të drejtësisë dhe veçanërisht në aspektin e qeverisjes së tij është shumë i rëndësishëm dhe i drejtpërdrejtë, sepse anëtarët e shoqërisë civile janë pjesë të këtyre strukturave dhe është një risi e reformës sonë në drejtësi, por më duhet të them dhe siç ne duhet të pranojmë gabimet tona, në këtë aspekt ka shumë vend për të reflektuar shoqëria civile. Unë besoj se kjo risi nuk e ka dhënë efektin e duhur, sidomos në dy këshillat që qeverisin sistemin dhe këtu ka nevojë për të bërë një diskutim, një debat në së ka vend të përmirësohet, cilat janë mekanizmat që mund ta bëjnë më eficente”, shtoi Xhafaj.

Ndërsa Gonzato u përgjigj se “së fundi, kur bëhet fjalë për një aspekt të rëndësishëm të reformës ishte përfshirja e përfaqësuesve të shoqërisë civile në institucionet e pavarura të drejtësisë dhe aty desha vetëm të përmend disa komente që janë bërë në raportin për sundim të ligjit të publikuar në korrik, ku në lidhje me anëtarët jo magjistratë kemi konstatuar se ka ende mangësi për shembull, në kontrollet e historikut dhe verifikimin e aseteve në krahasim me anëtarët magjistratë dhe se për rrjedhojë, kjo ka rezultuar në mungesë transparence, ndoshta edhe mungesë meritokracie në proces, kështu që patjetër që ka vend për përmirësim”.

Korrupsioni është një nga sfidat e mëdhatë Shqipërisë, dhe sipas ambasadorit të BE këtë nuk mund ta luftojë vetëm SPAK. Në këtë detyrë mund të bashkohet edhe superkomisioni i Xhafës, të cilit i tregoi se ku të fokusohet.

"Anti-corruption measures have so far had a limited impact, and I list here public infrastructure, cadastre and property rights, customs, tax administration, education, health, public procurement, public-private partnerships, etc. I hope that in the ongoing work of the Special Parliamentary Committee on Albania 2030, all stakeholders will take the opportunity to focus on these preventive measures - there is much that can be done in this area, based on evidence and broad consultation ," said the diplomat

In the annual report of the Center for the Study of Democracy and Governance, it is noted that during 2023, the number of new investigation cases for corruption decreased, but the number of convicts who were tried for this charge increased.
