Confiscated objects, what will be the development permit procedures?

The application procedure for the equipment with development permit, construction and certificate of use for facilities confiscated by the state as construction without permit, was recently approved by the Council of Ministers.

The process of confiscation of buildings with illegal additions started last year, with approximately 24 objects confiscated in total, where only from the first nine objects 10.5 million euros were collected in the state coffers. 3.5 million euros were collected for five objects and 7 million euros for another four from the process of punishing builders who exceeded the limits of building permits and the lack of interest from owners to pre-purchase these square meters.

After the decision to confiscate a construction without a permit by the National Council of the Territory, the Agency for Territorial Development is charged with the main responsibility for issuing development permits, upon request from the public institution or other beneficiaries who have under administration the confiscated facility.

Specifically, the application for a development and construction permit is made at the Local Self-Government Unit or at the National Council of the Territory through the e-Albania portal, in the e-Permits section. In the e-Permit electronic system, for applications to the Local Self-Government Unit, it is required to complete the form and upload the necessary documentation.

Within ten working days from the technical review, the mayor notifies the applicant through the electronic permit system, of the approval and issuance of the construction permit document or the decision to reject the construction permit. At the National Territorial Council, applicants can apply directly for the amendment of the building permit, without the need for the device with a development permit.

After completing the form and submitting the necessary documentation, the Territorial Development Agency examines the building permit requests, while the National Council of the Territory within 20 working days from the presentation of the technical evaluation report decides on the approval or rejection of the construction permit.
