Compensation of properties, institutions, hundreds of documents for properties

Albanian institutions have sent hundreds of letters to the Property Handling Agency asking for information on whether assets that were of interest for investment or privatization were on the list of restitution or compensation.

ATP in its annual report last year cites that the interest has been from central and local institutions, including the Investment Development Agency, Municipalities and even the Prime Minister. Specifically, 533 official requests asking for various information have been sent.

The first is the Albanian Investment Development Agency (AIDA) with 44 documents, where information is provided on various areas where investments have been proposed by entrepreneurship in the tourism, energy, economy sector if there are decisions aimed at the recognition, return or compensation of properties .

Second, the State Cadastre Agency, 369 documents, where information is provided on whether there are decisions on certain properties with the object of recognizing, returning or compensating the properties. This process is carried out for the reason that different subjects have applied to ASHK for the procedure of transfer of ownership and registration of real estates built until 10.08.1991 or registration of AMTPs.

Thirdly, there are different municipalities with 19 documents, where information is given mainly whether forest plots, located in the forest economy, have been treated with decisions for recognition, restitution or property compensation.

The Ministry of Finance and Economy, Branch of Public Societies, where confirmation has been requested if there are decisions on recognition of restitution or property compensation on various properties that are in the process of privatization and confirmation of the price of the surface of the state property based on VKM 89 dated 03.02 .2016 "For the approval of the land value map in the Republic of Albania".

Fourthly, the Ministry of Defence, 4 (four) letters regarding various assets in order to continue the leasing procedures, information was provided on whether there are decisions on recognition, return/compensation of property or the right of pre-emption.

Fifth, 31, where information is provided on whether there are approved decisions on recognition, restitution or property compensation on various assets subject to judgment, as well as whether there are applications administered by the ATP, not dealt with by a decision for the Courts of the First Instance of Jurisdiction of General as well as the Court of Appeal of General Jurisdiction.

The Prime Minister's Office 3 letters, through which an opinion was requested on various draft decisions proposed by the Council of Ministers.

Sixthly, 126 are requests from the Legal Representation Sector, regarding the evaluation of technical-legal documentation and the analysis of expertise acts, referring to the requests-lawsuits forwarded by the Courts of Judicial Districts, Courts of Appeal, the General State Attorney's Office or State Attorneys at local level.
