I do not know the concrete circumstances that have led to the conclusion that journalists Hoxha and Qyno should be placed under investigation and coercive measures.
Goodness wants us to understand more about the matter to avoid any error in reasoning.
However, a priori and in principle, looking at a decision of the investigating judge, I can say without fear that a journalist cannot be investigated for the source of the data he provides for his informative work.
This is a principle already consolidated in the entire space of the Council of Europe, where we are also members.
Artan Hoxha has publicly exposed many criminal events, hash plots, wanted persons, serious public events such as January 21, provided authentic testimonies that shed light on many unknowns.
Was he wrong?
Undoubtedly.
But he did the job.
He is probably the only journalist who has done his job by providing information from the source. He has managed to enter the criminal underworld to reveal what we have seen of him in public.
Of course, this is a very risky business because there are always "adversaries" of rivals who do not like transparency. There are certainly people from this world where he messes up, who do not like transparency.
In this sense, Tan Hoxha has performed a job with a lot of risk and not without financial costs. I remember here that the owners of the media, not infrequently, have been attacking Him.
Now, to think that this risky job can lead you to criminal prosecution is ABSURD!
I repeat, legally the journalist has the legal right and professional duty not to reveal the source of the news.
On the other hand, the claim that exposing the activity of a criminal group to the public is called corruption in the private sector because it was done in favor of another criminal group, is more than ABSURD!!!
I can find no logical connection to the written law.
It is the same as telling the prosecution that you are attacking one political group in favor of another group, when by law the prosecution is simply doing its job. I made the comparison this way because, if SPAK claims that it is doing its work according to the law and not according to political interests, it should withdraw the absurd insinuation with the same logic towards Tan Hoxha.
These two moments are like two similar drops of water.
Finding the news at the source has no chance to be called corruption, under any circumstances. Tan Hoxha is a journalist of the news source, not a journalist who buys news by SMS from within the system. By the way, those prosecutors or policemen who send SMS with investigative materials to journalists are the real corruption.
On the other hand, the journalist uses any tool, without exception, to mess up the news because he does not have the legal burden, as the prosecutor has, that the tool must be legal.
So even the idea that the journalist "used Sky" is completely irrelevant. Firstly using Sky was not illegal and secondly a journalist makes a living using this tool too.
So as far as SPAK associates the journalist and the decision of the investigating judge, they have not confirmed anything. On the contrary, they have made it worse.
The journalist's part of his duty is completely legitimate and protected by law. For others, if any, it's another topic.
