Prime Minister Edi Rama has shared on his Facebook the statement of Gianluca Esposito, Director General for Human Rights and the Rule of Law, regarding the practice of pre-trial detention in our country.

"Prison overcrowding remains a major challenge for the Albanian prison administration, and I'm not saying this. Our Committee for the Prevention of Torture says it."

Detention on remand can be justified in a given case only if there are specific indications of a real need in the public interest. The Court of Human Rights also notes that national judicial authorities must consider adopting less intrusive measures than detention on remand at the pre-trial stage, depending on the specific circumstances of the case.

It is the responsibility of the judicial authorities to ensure, in a given case, that the detention of an accused person does not exceed a reasonable period. The Strasbourg Court clearly states that the burden of proof in such cases should not be reversed by placing the onus on the detained person to prove the existence of reasons justifying his release.

"The main problem with the practice of pre-trial detention in Albania is the excessive and insufficiently justified use of this measure, especially in first instance courts and during periodic reviews ," Esposito declared yesterday in Tirana, January 29.

The head of government writes alongside the video that "arrest without trial has brought about the scandalous result of a European country with more pre-trial detainees than prisoners, alarming even the Council of Europe."

Even at the end-of-year conference, Rama considered the EC's practice of pre-trial detention in the country to be an alarm, appealing for intervention as soon as possible.
