Murder of Marigona Osmani, Appeal imposes life imprisonment for Dardan

The Kosovo Court of Appeals has confirmed the life imprisonment sentence against Dardan Krivaça, who was found guilty of the murder of Marigona Osmani.

The Appeals Court announced that in addition to confirming the conviction of Krivaqë, who was found guilty of the crime of "aggravated murder", the 15-year prison sentence against Arbër Sejdiu, convicted of the crime of "assistance in the commission of aggravated murder", was also confirmed.

Marigona Osmani was 18 years old when she was murdered on August 22, 2021, in Krivaca's apartment in the city of Ferizaj. Krivaca and Sejdiu were initially convicted of Osmani's murder in August 2023. However, the Court of Appeal, after accepting several appeals from the defense, sent the case back for a retrial.

On September 26, 2024, the first instance of the judiciary pronounced the sentences against the two defendants. The Basic Prosecution Office of Ferizaj, the representatives of the injured parties and the defense lawyers of the defendants had filed appeals against this verdict in the Court of Appeal, but the Court of Appeal said on February 19, 2025 that they were unfounded.

The Appeals Chamber stated that it found no violation of the provisions of criminal procedure, in order to annul the verdict. The announcement also stated that all evidence used in the trial had been analyzed and the Appeals Chamber assessed it as "fair, objective and lawful."

"Regarding the appeal claims regarding the erroneous and incomplete determination of the factual situation, the trial panel finds that the first instance court has correctly and completely determined the factual situation, because the evidence administered during the trial established that the defendants DK and AS committed the aforementioned criminal offenses, for which they were found guilty," the Court of Appeals announced.

The Appeal also said that it did not find any violation of the law regarding the amount of the sentence imposed by the Basic Court of Ferizaj.

What was said in the indictment against Krivaça and Sejdiu?

According to the indictment, Krivaça, on August 21, 2021, at around 10:14, in his apartment, without the consent of the now deceased Marigona Osmani, forced her to have sexual intercourse and abused and mistreated her in various ways. According to the indictment, a day later, on August 22, 2021, Krivaça and Sejdiu killed the deceased in an attempt to hide the criminal act of rape.

Krivaça and Sejdiu took the victim's body to the city hospital, and then fled in an unknown direction. They were also accused of committing the crime of rape, but were found not guilty due to lack of evidence. /REL
