VOA: Why did SPAK seize the naval base in Saranda, the government leased it to
The military base in Limion of Saranda and the decision of the Special Court

In Albania, the Special Court Against Corruption and Organized Crime has accepted the request of the Special Prosecutor's Office for the preventive seizure of the "Auxiliary Base, Limion, Sarandë", a naval base, property of the Albanian army, which in July year 2020, by decision of the government, it was leased, as part of a much larger territory, of over 265 thousand square meters, to the merger of the companies "Concord Investment" sh.pk and "Kastrati Group" sh.a. , represented by the company "Marina Bay Saranda" shpk, as tenant. The company, according to publications on the website of Concord Investment, envisages the construction of a complex of hotels, residences and a yacht port that will offer the possibility of mooring for 400 ships.

According to the Court's decision, which the Voice of America has been able to see, the prosecutor's submission that the investment in the field of tourism, or other constructions by the investor, on property 696 (Auxiliary Base, Limion) should be stopped is considered correct. ), for the reason that the free disposal of this property by private entities, affects the readiness and operationality of the Naval Force, operationality which must continue to be carried out by the competent body which is the Command of the Naval Force, without the intervention of private entities".

The investigation into this issue was initiated after a report by the former Deputy Commander of the Naval Force Artur Meçollari, according to which the leasing was done in violation, as this base is part of the Deployment and Deployment Plan of the army, and for this reason for this reason, the approval of the President of the Republic, in the capacity of the Commander-in-Chief of the Armed Forces, would have to be obtained. The government, for its part, has referred to a decision of the Council of Ministers from 2014 "for determining the criteria, procedure and manner of leasing, enphyteosis or other contracts of state property". According to her, it is about rental use, and not extraction from the Expansion and Settlement Plan, which would also require the approval of the President.

But according to Mr. Meçollari, in the lawsuit submitted to SPAK, in 2021 "properties in accordance with law no. 64/2014, "On the powers and authorities of direction and command in the FA" are considered operational capacities approved by the President of the Republic in the list of the Deployment and Deployment Plan. Actions on the properties of the Armed Forces, which are considered operational capacities, must be handled not only according to Law No. 8743, dated 22.2.2001 "On the immovable properties of the state", but also the law no. 64/2014, "On the powers and authorities of direction and command in the FA".

For this matter, Mr. Meçollari was summoned two days ago to the Special Prosecutor's Office, as a complainant. At the same time, for more than 3 hours, the former chief of the General Staff of the army, Bardhyl Kollçaku, currently a deputy of the Socialist Party, stayed at the Prosecutor's Office.

Mr. Meçollari has long since filed a second lawsuit for a private construction inside the military base in Shengjin. /VOA
