The Albanian Committee of Helsinki has reacted to the death at the hands of the Police of 32-year-old Lear Kurti, who allegedly died after swallowing two doses of cocaine out of fear of the blue uniforms.
KSH casts doubt on the reaction of the officers and according to her, the police should have sent the young man urgently to the hospital and not to the police station, as they have immediately established that he is in a bad state of health.
KSHH calls for the prosecution to investigate the legality of the actions carried out by the police forces, the cause of the victim's death and whether this event could have been prevented, under the conditions of the actions or omissions that the representatives of public order were obliged to perform.
Full reaction:
The Albanian Committee of Helsinki (KSHH) based on the media data of 20.10.2022 on the 32-year-old LK, according to which it was found that he was accompanied to the Police Station no. 3 (Tirana), and was subsequently sent to the Trauma Hospital where his death was confirmed, he considered it necessary to verify these data on the spot.
KSHH considers it necessary to mention that in this particular case, we are neither before escorting, detention nor before arrest in flagrante delicto, which the Code of Criminal Procedure provides. In these circumstances, the Police officers have acted in violation of Article 27 of the Constitution and Article 5 of the European Convention on Human Rights, which provide for cases where a person's freedom can be limited.
From the data verified by the Service Report, drawn up by the operating room of the Tirana Local Police Directorate, it has resulted that the poor health condition of the LK citizen was ascertained by the law enforcement at 23:34. Taking into account the above, Police officers would have to strictly implement Article 17 point "a" and Article 89 point "c" of Law no. 108/2014 "For the State Police", immediately and urgently transporting the LK citizen to the hospital, and not taking him to the premises of the Police Station.
Considering the nature of the case, in such cases it is the Prosecution body that must further investigate the legality of the actions carried out by the police forces, the cause of the victim's death and whether this event could have been prevented, in the conditions of the actions or non-actions that the representatives of public order were obliged to perform.
