Referring to previous reports in the media, the Court of Appeal of General Jurisdiction informs the following:

On 02.02.2022 at around 02:00 a.m., a notification was received from the operating room in Tirana that in the neighborhood called "Vilat Germane", at the beginning of "Tre Vëllezërit Kondi" street, Tirana there was a conflict between some citizens, a conflict accompanied by the use of firearms.

In the Court of the Judicial District of Tirana, the trial was conducted in relation to the criminal case that belongs to the defendant with the initials ES, accused of committing the criminal offenses "Unauthorized possession and production of weapons, explosive weapons and ammunition" and "Disturbance of public peace" ”, provided by articles 278/1 and 274 of the Criminal Code.

The Court of the Judicial District of Tirana, with decision no. 302, dated 08.02.2023 decided:

The guilty plea of ​​the defendant EAS for committing the criminal offense "Possessing without permission and the production of weapons, explosive weapons and ammunition", provided by article 278/1 of the Criminal Code, and his sentence of 5 (five) years of imprisonment .

The guilty plea of ​​the defendant EAS for committing the criminal offense "Disturbance of public peace" provided for by Article 274/1 of the Penal Code, and his sentence of 6 (six) months of imprisonment.

In application of Article 55 of the Penal Code, in joining the sentences, the EAS convicts the defendant with a single sentence of 5 (five) years of imprisonment.

Në zbatim të nenit 406/1 të Kodit të Procedurës Penale, të pandehurit E. A. S. i ulet 1/3 e dënimit të dhënë, duke u dënuar përfundimisht me 3 (tre) vite e 4 (katër) muaj burgim.

Vuajtja e dënimit me burgim për të pandehurin E. A. S. fillon nga dita e arrestit, më datë 05.02.2022 dhe të kryhet në një burg të sigurisë së zakonshme.

Në bazë të nenit 190 të K.Pr.Penale, prova materiale sekuestruar sipas procesverbalit datë 02.02.2022 për efekt të procedimit penal Nr. 919 të vitit 2022, të asgjësohen.

Shpenzimet proçeduriale hetimore dhe ato gjyqësore i ngarkohen të pandehurit.

Kundër këtij vendimi mund të bëhet ankim në Gjykatën e Apelit Tiranë brenda 15 (pesëmdhjetë) ditëve duke filluar ky afat nga dita e nesërme e njoftimit të vendimit.

Çështja në apel u shqyrtua vetëm mbi bazën e ankimit të bërë nga i pandehuri E.S., që kërkoi:

Ndryshimin e vendimti Nr. 302, datë 08.02.2023 të Gjykatës së Rrethit Gjyqësor Tiranë në paragrafin 5 të dispozitivit të vendimit dhe konkretisht:

pezullimin e ekzekutimit të dënimit, për pjesën e mbetur prej 1 vit e 9 muaj (21 muaj) burgim për të pandehurin E.S, sipas dispozitave të nenit 59 të K. Penal, si dhe urdhërimin që i dënuari të mbajë kontakte me shërbimin e provës dhe të vihet në provë, me kusht që gjatë kohës së provës të mos kryejë vepër tjetër penale.
Në përfundim të gjykimit, më datë 17.07.2023, Gjykata e Apelit të Juridiksionit të Përgjithshëm, e përbërë nga trupi gjykues me Relator Gjyqtar z. Dritan Hasani dhe anëtar Znj. Emona Muçi dhe Z. Genti Shala, vendosi:

-Lënien në fuqi të vendimit Nr. 302, datë 08.02.2023 të Gjykatës së Rrethit Gjyqësor Tiranë, me këtë ndryshim;

- Based on Article 59 of the Criminal Code, the suspension of the execution of the prison sentence and the placing of the defendant ES on probation for a period of 3 (three) years;

- The defendant is ordered to keep in contact with the probation service.

- The immediate release of the defendant ES is ordered, if he is not held for other legal reasons.

- Against this decision, an appeal can be made to the Supreme Court, within 45 days from the day after the announcement of the decision.
