The Special Prosecutor's Office acted in violation of Article 149 of the criminal procedure code by not administering all the evidence that was in the incinerators file, leaving the former Minister of Finance out of criminal responsibility.

"Referring to article 149 of the code of criminal procedure, Spak should primarily initiate an investigation, especially since there are reports against Mr. Ahmetaj in this particular case. Spak is obliged to administer the evidence. It is proven that this citizen has received benefits from the incinerators", said lawyer Ermal Hamataj.

On December 5, SPAk closed the investigations for the incinerators file, taking 21 people as defendants to the Special Court, among them former minister Lefter Koka and former general secretary Alqi Blako, while the former minister remained outside. But for lawyer Hamataj, this does not mean that a new investigation cannot be opened.

"Closing the investigations does not mean that a new proceeding cannot be started against Mr. Ahmetaj. The evidence is more than enough. SPAK must start investigations and show that it is serious", said Hamataj for Tch.
