Albanian sentenced to life in prison in Austria after attempted robbery of 1.5

An alleged robbery worth millions of euros resulted in one of the three perpetrators being sentenced to life in prison, a decision that is not yet final. His two accomplices were each sentenced to four years in prison, decisions that are now final.

MY NAME

Almost a year after the incident, the Assize Court has handed down its verdict against three men who forced their way into the home of a couple from Amstetten, Austria. The perpetrators intended to steal 1.5 million euros, but the money was never in the house.

The resident of the house, a pensioner, surprised the thieves. However, they did not leave, but continued their plan. One of them held the woman at gunpoint, while the other two continued to search for money and valuables.

The two Kosovars and the Albanian left only when, by chance, the doorbell rang.

During the escape, one of them, then 58 years old, was involved in a shootout with two police officers. He and one of his accomplices were arrested that same day. The third managed to escape for the time being, but the police found him a few days later. Since then, all three have been in custody.

A bag was seized.

Most of the evidence process had been completed by the first court session in February. In the meantime, investigators managed to seize a sports bag.

The bag belonged to the third defendant and various burglary tools, radio communications, duct tape and vehicle license plates were found inside it.

The prosecution interpreted this material as evidence that the robbery was carefully planned in advance. The perpetrators could have used duct tape, for example, to tie up people who might be in the house.

Robbery or burglary?

All three defendants pleaded guilty to burglary. However, the prosecution charged them with aggravated robbery.

The distinction is important: in the case of theft, the perpetrator takes something that belongs to a person. Robbery, on the other hand, means that the perpetrator uses force or threats to take the person's property.

Robbery is punishable by one to ten years in prison. If the robbery is committed with the use of a weapon, as was alleged in this case, the sentence can be from one to 15 years in prison.

In the case of a burglary in a dwelling, the maximum sentence is five years in prison.

The resident was left traumatized.

The jury members had to decide under which section of the law the three men should be convicted.

Both the prosecution and the defense tried to convince them during closing arguments.

According to the prosecutor, this was a very serious crime. The three defendants had carefully planned the crime and had divided the tasks among themselves in advance.

With an iron crowbar and plastic ties, they had threatened the pensioner and put her in a state of terror, making her believe that her life was in danger.

Since the incident, the homeowner has been suffering from post-traumatic stress disorder (PTSD).

Violence was denied as an intention

According to their lawyers, the defendants did not intend to use violence against the woman. The second defendant had a pistol with him, but it was not loaded. Furthermore, the robbery was not successful, as instead of taking 1.5 million euros, they left empty-handed.

Shootings at police officers

The prosecution also charged the second defendant with attempted murder.

After fleeing the property, two police officers pursued him. He fired at least three shots, from a distance of 11.5 to 12.5 meters. The officers were not hit.

According to the Albanian, he had fired into the air. However, an expert examination presented contradictory evidence. Gunpowder traces and a bullet hole in a tree suggested more that the 58-year-old had fired at the police.

The legal representative of the two police officers, involved in the process as a private party, called this a "cold cost-benefit calculation". According to her, the Albanian had previously been in a similar situation, where he had managed to shoot to escape the police and avoid arrest, at least temporarily. The victim in that case later died from bullet wounds. For this incident, the Albanian had previously been sentenced to 18 years in prison for murder.

The jury's decisions were unanimous.

The eight jurors unanimously answered all questions on guilt.

They found all three defendants guilty of robbery, but not of aggravated robbery with a weapon. According to the jury, the pistol and crowbar were not used as weapons during the robbery and the pensioner was not threatened with them.

The two Kosovars, who had no prior criminal record, were sentenced to four years in prison each. These decisions are final.

The Albanian was also found guilty unanimously of two attempted murders and illegal possession of a weapon. Taking into account the combination of several criminal offenses and his previous conviction for murder, the court sentenced him to life imprisonment.

This decision is not yet final, as the second defendant has appealed the sentence.

Reparations

The court awarded the pensioner 7,050 euros in compensation for the pain and suffering caused by the three convicts.

The court awarded 5,000 euros each to the two police officers who were shot by the Albanian man, for the psychological consequences of the incident.

Meanwhile, the cash seized from the defendants, in the total amount of approximately 8,500 euros, will be divided proportionally to cover these damages.
