New GJKKO regulation, journalists sue the Constitutional Court: We will seek its

The Journalists' Association of Albania has filed a request with the Constitutional Court challenging the internal regulation of the GJKKO, widely considered censorious towards the media and journalists.

AGSH initially requests the suspension of the regulation and then its repeal as incompatible with the constitution for the part pertaining to the media and journalists.

" We have submitted a request to suspend the GJKKO regulation, and then to declare it unconstitutional. We are convinced that this regulation violates media freedom and the right of journalists to convey to the public what happens within GJKKO. Censorship regulation towards the media. I express my disappointment towards GJKKO, where despite our calls for a dialogue, a roundtable discussion, GJKKO has not taken the trouble to contact journalists or create bridges of communication so that this regulation becomes better for freedom of expression.

The complaint must be based on the constitution of the republic. The main point we have raised is the impact of freedom of expression and the right to information, which are two of the main pillars of democracy. We have specified in the 127-page lawsuit all our concerns, including access to justice for the media and citizens. The forms to access a WhatsApp group are absurd and meaningless. It is up to the 8 members of the Constitutional Court to decide whether there is a constitutional violation and how far it goes , ”said Isa Myzyraj, head of AGSH.

The GJKKO regulation entered into force on September 1, while it was published at the end of July, when the institutions had already started their summer vacation. Journalists, media organizations inside and outside the country opposed it, initially calling on the GJKKO to postpone the entry into force and to consult with journalists beforehand! But on September 1, the GJKKO ignored everyone inside and outside the country when it announced the entry into force of the regulation, while a day earlier it also closed the WhatsApp group with all journalists, where the official announcements of this court were distributed. A new group has been announced that it will not be opened, but only with accredited journalists.

Through the new regulation, the GJKKO prohibits the presence of journalists in court sessions with their mobile phones, an indispensable tool for real-time communication with their editorial offices. In practice, journalists are limited to taking notes only with pen and paper. They are not even allowed to record the audio of the session, while the Court itself refuses to give them one. The presence of cameras is almost excluded, in open defiance and with a special instruction of the High Judicial Council.
