BEHIND THE SCENES of judges' mandates/ Conflict of interest and
Constitutional Court

A seemingly naive request by the President of the Republic, Bajram Begaj, for the interpretation of the duration of the mandates of the Constitutional Court, concealed the intention to prematurely terminate the mandate of the member of that court, Sonila Bejtja.

But what the Constitutional Court itself produced to fulfill the "wish" of the Head of State is a complete chaos in terms of mandates, which within a short time will collapse the highest institution of justice in the country.

The Constitutional Court this week revealed the decision taken on October 16, 2025. Previously, this decision was a true "hara-kiri" of the constitutional judges, who, in order to terminate Judge Bejtja's mandate 3 years early, also deprived themselves of 1 to 3 years.

In order to save their mandates as much as possible, the majority of the constitutional body has undertaken a maneuver that is at the very least considered a pure conflict of interest and, most likely, within the limits of a criminal offense.

Some are "more equal than others"

In January 2025, President Begaj was unclear about the length of time that members of the Constitutional Court should remain in office and requested an interpretation of the terms from the latter.

Upon this request, the Constitutional Court, by majority vote, adopted decision no. 60/2025, where, among other things, it gave the following interpretation: "The beginning of the mandate of the judge of the Constitutional Court during this transitional regime coincides with the date declared by the Constitutional Court of the end of the mandate of the judge he replaces."

In a more simplified way, the beginning of the term of office of incumbent judges would not be calculated from the moment of their appointment and swearing in, but from the moment when their predecessor judge had completed his term.

This scheme affected all serving judges, as almost all of them had been appointed to office long after the end of their predecessors' terms.

But, as in George Orwell's "Animal Farm", some judges showed that they are "more equal than others."

maneuvers

The Constitutional Court approved the decision with the votes of five members; Fiona Papajorgji, who is currently the chairperson, Ilir Toska, Sandër Beci, Marsida Xhaferllari and Marjana Semini.

In the decision, which was revealed three months after its approval, a maneuver was found that was both stupid and flagrant.

The majority of the Constitutional Court has only given its interpretation for the mandates of two judges; Elsa Toska , who resigned in 2024, and the incumbent member, Sonila Bejtja.

Shkurtimi i mandateve

– Gjyqtara Marsida Xhaferllari, me mandat deri në vitin 2028, tashmë, sipas interpretimit të shumicës ku ajo vetë është pjesë, i përfundon mandati në vitin 2027;

– Gjyqtarja Fiona Papajorgji, me mandat deri në vitin 2028, me interpretimin e miratuar prej saj, mandati i zvogëlohet me një vit dhe i përfundon në vitin 2027;

– Likewise, Judge Gent Ibrahimi's term is reduced by several months.

– The only mandate that is not affected by this decision is that of Judge Sandër Beci, as his position is defined in the Constitution as being partial, only 6 years and ends in 2028.

The expected collapse

The initial request of the President of the Republic aimed, according to him, to clarify the duration of the mandates of the members of the Constitutional Court.

But this court's decision not only failed to clarify anything, but also created the premises for a constitutional collapse in a very rapid time.

The minority judges have predicted a not-at-all positive scenario.

"This approach of the majority, not only did not want to justify the effects and consequences of this interpretation on the mandates of each of its members, ...., but will subsequently cause uncertainty and a constitutional impasse, both for the Court and for the appointing bodies themselves, in view of the moment at which the procedure for declaring the end of the mandate of the judges in office will have to begin, which, referring to the enacting clause of the majority decision, is a completely different moment from the one it has determined in the reasoning of its decision."

The consequences of this decision-making are expected to have collapsing effects no later than 2027, when the institutions of the name, the Presidency, the Assembly and the Supreme Court, will demand "their right" to appoint new constitutional judges, referring to the decision of the Constitutional Court itself./ boldnews
