Today, the implementation of the criminal amnesty for over 1,300 prisoners begins. The law, which was approved on June 18 and decreed on June 30 by President Bajram Begaj, has already entered into force. Women and minors also benefit from it.
According to the law approved by the vote of 84 deputies, 81 socialist lawmakers and three PSD lawmakers, all those who have received a final decision by May 31 of this year will benefit, including if the Appeal decision has not yet been made public.
Given that a period of time has passed since the adoption of the law and its subsequent entry into force, this may affect the increase in the number of beneficiaries who may have met the deadlines.
According to preliminary data, about 120 prisoners will be released from the Kosovo prison in Lushnje, about 98 in Fier and 200 will receive a reduction in sentence. About 60 prisoners are expected to be released from the Drenova prison in Korça and 15 women from the prison in Pojska.
According to the law, men sentenced to imprisonment for up to 3 years or lighter sentences of fines, or other alternative sentences, women sentenced to imprisonment for up to 4 years or lighter sentences will be released. Men who are currently in prison and have up to 3 years of their sentence left to serve, as well as women who have up to 4 years of their sentence left to serve, will also be released.
Another qualifying criterion is age. Men over 60 years old, women over 50 years old, and people who were under 18 years old when they committed the criminal offense, regardless of the sentence, but not when they are in prison for serious offenses that are excluded from the amnesty.
Those convicted of a number of serious criminal offenses, including intentional homicide and crimes against life, crimes against humanity, rape and sexual crimes, human trafficking, and many other serious offenses, remain excluded from the amnesty. Also excluded will be persons who have evaded justice, i.e. those who have gone into hiding, escaped, or evaded the execution of a criminal sentence.
All offenses that fall under the jurisdiction of SPAK, and all persons who have a decision from the GJKKO will not be able to benefit regardless of what they have been convicted of.
Other beneficiaries are exempt from criminal prosecution for certain minor offenses and low-risk offenses.
