The Minister of Justice, Besfort Lamallari , has officially requested the High Inspectorate of Justice to initiate a disciplinary investigation against the judge of the First Instance Court of General Jurisdiction of Lezha, Ilir Përdeda .

The letter signed by Lamallari argues for the violations committed by the judge.

Specifically, Judge Ilir Përdeda has not released the reasoned decision for a year, thus preventing the parties (in this case, the appellant) from effectively appealing that decision.

"The failure to disclose the reasoned decision by the judge for 1 year constitutes a significant delay, which has prevented the parties (in this case the appellant) from effectively appealing that decision. Since the parties do not have the reasoned decision of the court, the appeal is made more difficult, as the arguments with which the court rejected the claims of the parties, or of the party that disagrees with the decision, are not known," the letter signed by the Minister of Justice, Besfort Lamallari, states.

The decision by the judge was taken on 18.12.2024 and as of 10.12.2025 has not yet been filed with the Chief Secretariat of the First Instance Court of General Jurisdiction in Lezha.

"From the administrative investigation conducted by us through receiving information from the Chancellor of the First Instance Court of General Jurisdiction of Lezha, it results that: the court file pertaining to the aforementioned decision, by 10.12.2025, has not yet been submitted to the office of the chief secretariat by the judge of the case, Ilir Përdeda, in order to carry out further actions to communicate the decision to the parties in the process. Therefore, from the date of the announcement of the final decision in the court session of 18.12.2024 until 10.12.2025, there is a time difference of about 1 year," the request sent to the High Inspectorate of Justice further states.

The plaintiffs in this civil lawsuit are: Fran Bushpepa, Marte Bushpepa. The defendants are Drane Përlleshi, Anton Pjetri, Xhuana Pjetri and the State Cadastre Agency.

The violation committed by the judge prevents the delivery of justice within a reasonable time frame, for a due process of law, therefore the Minister of Justice assesses that there is room for initiating a disciplinary investigation for violation of Article 308 of the Code of Civil Procedure.
