The Court of Appeal of the General Jurisdiction reduced the sentence of Granit Shehu , who killed his cousin in 2015, to 2 years and 6 months in prison.

So in conclusion. Shehu was sentenced to 13 years and 4 months in prison. 

The Tirana Court sentenced him to 16 years in prison, a decision which was also upheld by the Tirana Court of Appeal.

Against the decision of the Tirana Court of Appeal, the Prosecutor's Office at the Tirana Court of Appeal appealed, which requested the cancellation of the decision of the Tirana Court of Appeal and the return of the documents for reconsideration to this court", as well as the defendant, who requested the cancellation of the decision. of the Tirana Court of Appeal and the return of the acts for reconsideration by ordering the change of the legal definition of the criminal offense from "Murder with premeditation" to the offense "Murder in conditions of strong mental shock" or "Murder committed in exceeding the limits of the protection of necessary" and his punishment according to the relevant provisions.

Meanwhile, the Supreme Court has found the invalidity of the decision of the Tirana Court of Appeal "The annulment of decision no. no. 2082, dated 03.10.2018 of the Tirana Court of Appeal, and sending the case for reconsideration to the Court of Appeal of General Jurisdiction, with another panel of judges".

The latter took the decision to finally sentence him to 13 (thirteen) years and 4 (four) months of imprisonment.

Notification:

Referring to previous reports in the media, the Court of Appeal of General Jurisdiction informs the following:

In the Court of the Judicial District of Tirana, a trial was held regarding the criminal case that belongs to the defendant with the initials G (G). Sh, accused of committing the criminal offense "Murder with premeditation", provided by article 78/2 of the Penal Code.

The alleged fact is related to the event that happened on 16.09.2015, on "Horizonti" street, Kamëz Municipality. The citizen with the initials M. Sh was hit by the defendant G. (G). Sh (his cousin), several times with strong and cutting tools, causing him serious wounds, up to the loss of his life.

The Court of the Tirana Judicial District, with decision no. 3314, dated 31.10.2016 decided:

 The guilty plea of ​​the defendant G (G). Sh for committing the criminal offense of "Premeditated murder", and based on Article 78/2 of the Criminal Code, sentences him to 24 (twenty-four) years of imprisonment.

Në zbatim të nenit 406 të K.Pr.Penale, pas uljes së dënimit me 1/3, i pandehuri G (G). Sh dënohet me një dënim të vetëm përfundimtar prej 16 (gjashtëmbëdhjetë) vjet burgim.
Vuajtja e dënimit do të fillojë nga data e arrestimit.
Çështja në apel është shqyrtuar mbi bazën e ankimeve:

1.Nga Prokuroria  pranë Gjykatës së Rrethit Gjyqësor Tiranë, e cila kërkoi:

– Ndryshimin e vendimit të Gjykatës së Rrethit Gjyqësor  Tiranë ndaj të pandehurit me iniciale G (G). Sh .

-Deklarimin fajtor të të pandehurit me iniciale G (G). Sh ., për kryerjen e veprës  penale “Vrasje me paramendim e kryer për hakmarrje në dëm të shtetasit me iniciale M.SH”, të parashikuar nga neni 78/2 të K.Penal dhe dënimin e tij me burgim të përjetshëm.

-Në aplikim të nenit 406 të K.Pr.Penale, dënimin e tij me 35 (tridhjetë e pesë) vjet burgim.

2.Nga i pandehuri me iniciale me iniciale G (G). Sh  i cili kërkoi :

–Deklarimin fajtor të të pandehurit me iniciale G (G). Sh për veprën penale të parashikuar nga neni 82 i Kodit Penal “ Vrasje e kryer në gjendje të tronditjes së fortë psikike” apo 83 i K.Penal “Vrasje e kryer në kapërcim të kufijve të mbrojtjes së nevojshme” dhe dënimin e tij sipas dipsozitave përkatëse.

Gjykata e Apelit Tiranë, me vendimin nr. 2082, datë 03.10.2018 ka vendosur:

–Lënien në fuqi të vendimit penal nr. 3314, datë 31.10.2016 të Gjykatës së Rrethit Gjyqësor Tiranë.
Ndaj vendimit të Gjykatës së Apelit Tiranë, kanë ushtruar rekurs :

1.Prokuroria pranë Gjykatës së Apelit Tiranë e cila kërkuar:

-Prishjen e vendimit nr.2082, datë 03.10.2018 të Gjykatës së Apelit Tiranë dhe kthimin e akteve për rishqyrtim kësaj gjykate”.

I pandehuri me iniciale me iniciale G (G). Sh i cili ka kërkuar:
-Prishjen e vendimit nr.2082, datë 03.10.2018 të Gjykatës së Apelit Tiranë dhe kthimin e akteve për rishqyrtim duke urdhëruar ndryshimin e cilësimit juridik të veprës penale nga neni 78/2 të K.Penal “Vrasja me paramendim” në veprën e parashikuar nga neni 82 të K.Penal “Vrasja në kushtet e tronditjes së fortë psikike” ose neni  83 i K.Penal “Vrasje e kryer në kapërcim të kufijve të mbrojtjes së nevojshme” dhe dënimin e tij sipas dipsozitave përkatëse.

Gjykata e Lartë bazuar në nenin 112/3 , të K.Pr.Penale  ka konstatuar palvefshmërinë e vendimit të Gjykatës së Apelit Tiranë për mungesë të arsyetimit  lidhur me cilësimin ligjor të veprës penale  të “Vrasjes me paramendim”, të parashikuar nga neni 78/2 të K.Penal, dhe me vendimin nr. 298, datë 07.11.2023  ka vendosur:

“Prishjen e vendimit nr. nr. 2082, datë 03.10.2018 të Gjykatës së Apelit Tiranë, dhe dërgimin e çështjes për rishqyrtim në Gjykatën e Apelit të Juridiksionit të Pëegjithshëm, me tjetër trup gjykues”.

Në përfundim të gjykimit, më datë 23.05.2024, Gjykata e Apelit të Juridiksionit të Përgjithshëm, e përbërë nga trupi gjykues me Relator Gjyqtar z. Fatri Islamaj dhe anëtare znj. Edlira Petri dhe znj. Marsela Pepi, vendosi:

- Change of decision no. 3314, dated 31.10.2016 of the Court of the Judicial District of Tirana as follows:
- The guilty declaration of the defendant G (G). Sh for committing the criminal offense of "Deliberate murder", provided by article 76 of the Penal Code, and his sentence of 20 (twenty) years of imprisonment.

- Pursuant to Article 406 of the Penal Code, 1/3 of the punishment is reduced and ultimately the defendant G (G). Sh is sentenced to 13 (thirteen) years and 4 (four) months of imprisonment.

- Serving the sentence starts from the date of his arrest.

EVENTS

The Prosecutor's Office of Tirana requested a life sentence for the defendant Granit (Giuliano) Shehu, accused of "premeditated murder", as he is accused of having killed the citizen Milazim Shehu (his uncle's son) on 17.09.2015. The accused was investigated and tried in absentia. Based on the investigative material of the Prosecutor's Office of Tirana, it turns out that: On 17.09.2015, around 01.00, the State Police was notified through the operating room of the Tirana Police Directorate that the citizen Milazim Shehu was found dead in the "xxxx" hospital.

Immediately after receiving the notification, the investigative team was created and from the preliminary data it appears that on 16.09.2015, at around 18:00 on the "Horizonti" street of Kamzë Municipality, the citizen Milazim Shehu was hit by the citizen Granit Shehu (son of the uncle of his). The latter has hit the citizen Milazim Shehu several times with strong and cutting tools, causing him serious wounds in different parts of the body. This incident happened on the road between the two gates of the houses of these citizens and then the citizen Milazim Shehu was transported by his family members to the "xxxxx" Hospital, while the citizen Granit Shehu left, evading the investigations.
