Plaurent Dervishaj's lawyer, Ilia Ilia, claimed that one of the victims in this trial, Aleksandër Laho, known as "Rrumi", was the first to attempt to kill his client, after the latter was given power of attorney by the relatives of the murdered judge Skerdilajd Konomi, to help them take over their properties in Hamallaj, Durrës.
The lawyer for defendant Plaurent Dervishaj, who is accused of the November 2019 assassination attempt on former prosecutor Arjan Ndoja, currently a member of parliament for the Democratic Party, Aleksandër Lahos, known as "Rrumi", an organized crime figure in the Durrës and Shijak areas, and the murder of the late Andi Maloku, presented evidence at Tuesday's hearing that, according to him, shows that one of the injured parties had previously attempted to kill his client.
He also linked the conflict between Rrumi and Dervishaj to properties in Hamallaj, Durrës, which according to him belong to the family and relatives of the late judge, Skerdilajd Konomi, executed 15 years ago, adding that the investigations into the magistrate's murder raise suspicions that he was eliminated because he was helping relatives acquire the properties.
The Special Prosecution Office accuses Plaurent Dervishaj of having, in collaboration with Redjan Rraja, Ariol Halili, Julian Meçaj, Bledar Polovina, Amar Shkëmbi (alias Dritan), Ramazan Rraja, Endrit Sinan, Genti Nderjaku, Bashkim Haxhija and Julian Pjetri, carried out the assassination of former prosecutor Ndoja, Aleksandër Laho and the late Andi Maloku. Dervishaj and Meçaj are being tried separately from the other defendants, some of whom have been tried and found guilty.
Thus, the court sentenced Redjan Rraja to life imprisonment, Ariol Halili to 35 years in prison for this murder. Also convicted are Ramazan Rraja, Genti Nderjaku, Bashkim Haxhia, Endrit Sinani and Julian Pjetri.
The mafia-style execution with explosives of Judge Konomi on September 9, 2011 shocked the judiciary and state institutions. Konomi was assassinated in the morning while he was on his way to work at the Vlora Court. Investigations found that the deceased initially noticed that the car he usually used had a flat tire and took the car used by his wife, a Benz model from the 80s-90s.
On the way, the vehicle exploded and Judge Konomi died a few moments later. The horrific scene was broadcast live by the media, causing panic among the public. The expert examination showed that at least 400 grams of C4, mounted under the driver's seat, was used to carry out the attack. The incident remains unsolved, with no specific perpetrator or motive.
Prosecutor Adnan Xholi stated that the data being read by the lawyer constitutes an investigative secret, as it belongs to another case that is still under investigation. Lawyer Ilia stated that that data was made public by the media, as SPAK and the Special Court did not make it available to them, even though they requested it.
Xholi requested that the session continue behind closed doors, but Plaurent Dervishaj's other lawyer noted that she would also read the decision of the Independent Qualification Commission for former prosecutor Arjan Ndoja, which according to her has valuable information for the trial.
The trial panel decided to continue behind closed doors and later expressed its opinion on the requests of Dervishaj's lawyers for the receipt of new evidence, as well as Meçaj's lawyers, who requested the invalidity of the acts, bringing to attention the decisions of the Dutch judicial authorities, regarding the Sky ECC and Encrochat data. According to them, the Dutch courts have rejected the prosecution's requests to respond to these data. Meçaj's defense claimed that from the evidence they have provided, these interceptions result from being carried out in a massive and not procedural manner.
The court resumed the session after being adjourned for about an hour to decide on the defense's requests for the administration of new evidence. The presiding judge, Judge Marinela Osmani, noted that the KPK decision and other acts are not related to this criminal process. Regarding the request for the inapplicability of the data obtained from Sky ECC and Encro Chat, it was found that the court had previously expressed its opinion. The presiding judge also stated that the parties had knowledge and opportunity to submit the evidence at the appropriate procedural moment.
At this moment, lawyer Ilia Ilia stood up and said he was leaving. The court noted that his behavior was an insult to the court, as the hearing had not ended. As lawyer Ilia was walking through the courtroom, the court invited prosecutor Adnan Xholi to present his final conclusions, but he asked for time and the hearing was postponed to 8 May, at 09:30.
