The Special Appeals Commission has dismissed the head of the Lezha Prosecution Office, Erjon Shehaj.
The panel ruled in favor of Shehaj, who had previously passed the first stage of Vetting, even though the Independent Qualification Commission found problems with wealth and professionalism.
The Public Commissioner appealed the decision.
In the KPA's reasoning during today's session where the decision was made, it is emphasized that:
-Erjon Shehaj has not carried out investigative actions on the files and has violated the procedural guarantees of the individuals.
-Regarding one of the issues, the panel of judges states that it will not take a position, as the case is pending trial in the Supreme Court.
-In 4 cases, the panel of judges assessed that violations were found by the subject of the reassessment.
-In one of the proceedings, Shehaj had to withdraw due to a conflict of interest. His involvement in this proceeding has caused the invalidity of the acts of the criminal process.
The head of the Special Prosecution Office, Altin Dumani, was absent from the session. Shehaj, who was represented by lawyer Julian Mërtiri, was also absent.
How did the situation turn out?
Altin Dumani, head of the SPAK Special Prosecution Office, and also a representative of the Public Prosecutor's institution, requested on March 19 the dismissal of Erjon Shehaj, during a hearing held at the Special Appeals Chamber regarding the latter.
While presenting his claims to the KPA, Dumani argued that the decision of the Independent Qualification Commission (IKC) should be reversed and Shehaj should be dismissed from office as subject to re-evaluation.
"I request the change of the KPK decision and the dismissal from duty of the subject of the re-evaluation, Erjon Shehaj," Dumani emphasized during the session.
He has also submitted the relevant 22-page documentation, summarizing the conclusions on the matter.
While listing the violations of the Chief Prosecutor of Lezha, Altin Dumani focused on several cases investigated by Erjon Shehaj, in which, according to him, violations were found.
Altin Dumani stated during the KPA hearing that Shehaj did not conduct investigations into a case of impaired driving, favoring the position of the accused.
Meanwhile, in a case from 2017, according to the head of SPAK, it turns out that two people were convicted twice for the same criminal offenses.
Another issue raised by SPAK head Altin Dumani while presenting the claims relates to the arrest of a person who was caught with hashish and explosives.
Dumani states that Shehaj sent the case for trial and the person was sentenced to 6 years in prison. Explanations were requested from the KPK on this issue and Shehaj provided his explanations.
The KPK has said that no evidence was found to investigate the complaint, but the panel should investigate in this regard.
"In this file, no investigations have been conducted, where did the person get the drugs, where would he take them? Are we facing criminal offenses committed in collaboration? Where did he get the explosives? Did he assemble it himself? If he assembled it himself, it must be proven. The person was a social danger and the sentence was low," Dumani stated.
Dumani concluded by requesting the change of the KPK decision and the dismissal of the subject of the reassessment, Erjon Shehaj.
