Gogu on magistrates' salaries: The legal gap will be filled in the
Tony Gogu

Minister of Justice, Toni Gogu, speaks out after the Supreme Court and the Supreme Administrative Court increased their salaries.

Gogu says that the Constitutional Court's decision on magistrates' salaries is mandatory to implement, but currently there is no legal basis for the salary formula.

He said that the gap will be filled in the new parliamentary session, emphasizing that the solution must come from the Assembly and not from a clash between institutions.

Excerpt from Toni Gogu's speech

Public money is the citizens' money, not the government's. Every penny of the state budget must have legal authorization to be spent. This is the most important principle for everyone, it applies to everyone equally. We will defend this accountability that citizens expect from us without any hesitation.

The decisions of the Constitutional Court are enforceable, they are mandatory to be implemented, they are not negotiable, they are not relativized. The decision of the Constitutional Court on the salaries of magistrates is mandatory to be implemented by every institution.

The implementation of the Constitutional Court's decision and accountability for budget implementation require clear legal authorization to implement it. This is where the problem has arisen. It is the legal vacuum that is the cause of the entire situation we find ourselves in today.

We did not get here because someone asked for more and someone asked for less. We got here because we lack a legal basis for the magistrate's salary formula, which the Constitutional Court repealed. In the absence of legal authorization, the Ministry of Finance is unable to implement the Constitutional Court's decision.

This legal gap will be filled in the Assembly, in the new parliamentary session. My task is to ensure that this is done as quickly as possible and in full compliance with budgetary accountability.

The solution is not for the institutions to clash, but the solution is in the Assembly, in the coming days. This will be our direction, this will also be my duty in the role of Minister of Justice, to resolve this dispute.

The conflict between magistrates and the central government began after the Albanian Parliament ignored a decision by the Constitutional Court to implement the new salary formula by July 31. When the date passed, the KLGJ and KLP said they were obliged to implement the Constitutional Court's decision themselves while setting the reference salary.
