The Constitutional Court announced on Tuesday the decision in favor of the request of the Union of Judges, evaluating as unconstitutional the articles amended by the majority for the calculation of the basic salary and supplementary pension for magistrates in the Republic of Albania.
According to this decision, the government is forced to pay an additional 14,000 lek on top of the basic salary of each magistrate from 2019 onwards and to accept a new pension calculation for magistrates based on contributions, removing the President's salary as a reference of the Republic.
The decision enabling the salary increase for magistrates was taken unanimously by the Constitutional Court.
According to the announcement published on the official website of the Constitutional Court, the body decided to "repeal Article 12, point 5, letter "a", of Law no. 96/2016 "On the status of judges and prosecutors in the Republic of Albania", amended as incompatible with the Constitution of the Republic of Albania" and "Repeal of Article 1, point 7, second paragraph, letters "a", "b ” and “c” of law no. 8097, dated 21.03.1996 "On supplementary state pensions of persons performing constitutional functions and of state employees", amended, as incompatible with the Constitution.
The battle of judges to benefit from additional salary started at the beginning of 2021, after an audit made by the High State Control in the High Judicial Council. According to the KLSH report, an error in the interpretation of the law has denied the judges 14,000 Lek per month and that their reference salary should have been 132,100 Lek from the 118,000 Lek that was calculated until that time. The SSC made the new calculation based on a Decision of the Council of Ministers of 2017 on the approval of the structure and salary levels of civil servants.
