Fiks Fare followed for several days the case of the murder of 15-year-old Fatjon Bici , in May 2023 in the city of Gramsh.

The father, mother, and family members sought the help of the investigative show after two of the perpetrators of their son's murder were released from prison without being given any explanation.

Fiksi inquired at the Gramsh Police where he learned that the release had been made by the court and that the two perpetrators should be kept under house arrest.

Meanwhile, Fiksi inquired a few days ago at the Tirana Court of Appeal where he learned that the decision to release him was made due to numerous delays in the investigation and trial process at the Prosecution Office and the Elbasan Court.

The two perpetrators had been in prison for more than 18 months and the law states that they cannot stay in prison longer. Meanwhile, today, December 12, 2024, the next hearing took place and after the interest of "Fiks Fare", the Appeals Court returned the two perpetrators to prison, even upholding the decision of the Elbasan Court.

The mother's cry: They are 'playing' with my son's blood!

A few days ago, the Fiks Fare group traveled to the city of Gramsh, following a request for "help" from the family of the victim Fatjon Bici.

Mustafai and his wife sought the help of Fiks Fare because they accidentally learned that their son's murderer, Ergi Karaj, had been released from prison.

For the May 2023 event, they say that the mother was notified by the teacher and was told that they were a little unhappy with their son.

When they arrived, they found the boy lying on the ground, dead, at the scene near the 9-year-old "Asllan Shahini" school. According to the family, the source of the dispute was a friend of their son, Qetsor H.

The perpetrators set out to fight with Qetsor and their son intervened to separate them. They say they stabbed him several times in the heart and there were stab wounds all over his body.

The parents are very concerned about the court hearings and how they have been conducted. Once the judge did not come, another time the prosecutor did not come. After the decision was made for 18 years in prison, they appealed again and the trial was postponed to December 12 at the Tirana Court of Appeal.

Meanwhile, 2 of the perpetrators, one of whom is the main one, Ergi Karaj, sentenced to 27 years in prison (shortened trial 18 years), have returned home under house arrest. The victim's family learned this news from various residents of Gramsh. They then spoke with the chief of the police station who told them that this was true and that he was at home under house arrest. The family members are demanding the imprisonment of the perpetrators, without a shortened trial, and that justice be served.

The victim's mother bursts into tears and says, "They took my son." "There is no state, they should be in prison, 'my son is in the ground,' who will think about him. They are playing with my son's blood," says Afërdita Bici.

After the complaint, the victim's family members go to the Gramsh Police Station, where they ask to meet the Chief of the Police Station, but he is not there and they talk to other employees. The employee admits that the perpetrators are at home, being guarded by the police. They are not allowed to leave the house, because they are under house arrest. They are serving their sentence until another decision is made.

The police officer tells the family members that "there is no justice here, there is no court and no one should be punished." He adds that the perpetrators took him to the Court of Appeal and created a vacuum there and are now under house arrest. "They create problems for us so that we can keep the criminal and keep him in prison. We are also parents and we say, 'What is this?' He should be sentenced to life in prison," the police officer tells the family members.

"We will commit terror, a knife to the throat", the testimonies of the murderers

Fiks Fare has secured the investigative and judicial file of the murder of the 15-year-old. In the file, the perpetrators speak on the applications "Tik Tok" and "Snap Chat" that "we will commit terror." They even buy knives and gloves online in the city of Gramsh, despite being minors.

They testified that they shot him several times, the target was another person but the victim came forward. They say that they got into a fight on social media, cursed and insulted each other. "They hit Ergi in the face and then Ergi had a button knife in his right hand and stabbed him in the back with a knife. When the police caught us, Ergi threw the bloody knife away," one of them testified.

Another witness says that "on the Tik Tok app they asked me if I knew Qetsor and that he had problems with him and was going to fight. I installed the 'Snap Chat' app, where Orgito sent me photos with iron gloves and knives. In one of the messages, Orgita wrote to me saying 'did you see the photo of the iron glove' that I sent you on Snap Chat because I will come with these tools".

The file provides details from the examination of the perpetrators' phones, where Orgito's phone contains 7 photos mentioning the purchase of gloves. On "Tik Tok" conversations with the user Rudolf are observed where Orgito mentions "tomorrow you will see terror, see. Tomorrow you will see it".

Even in conversations on "Tik Tok" details are given about what they will do, even of the author Ergi Karaj with boxing gloves, conversations with Orgito who admits to having a knife and comments that "a knife in the throat", "a knife in the stomach".

The delay in the proceedings led to the release of the perpetrators.

The file also includes the final conclusions of prosecutor Neritan Hoxha, who has requested a sentence of 12 years in prison for the main perpetrator, Ergi Karaj (with a shortened sentence of 8 years). For Stiven Murati, Orgito Çarçiu and Xhonatan Çekrezi, he requested a sentence of 6 years and 8 months in prison each.

Meanwhile, the court, unlike the prosecutor, sentenced the main perpetrator to 27 years in prison and, with a summary trial, 18 years in prison. Stiven Murati to 6 years and 8 months in prison. Orgita Çarçiu to 14 years in prison and Xhonatan Çekrezi to 8 years in prison.

The court's decision was given by a majority, with one member of the court also having a minority opinion. Judge Thomaidha Roça believes that the summary trial should not have been accepted, as legislators have written in the Criminal Procedure Code that "a request for a summary trial is not allowed for criminal offenses for which a life sentence is provided."

The proceeding was registered on May 17, 2023. The prosecution sent the file to the court on November 17, 2023. Six months later, on April 29, 2024, the decision was issued by the Elbasan Court.

The delays have continued with the release of the decision. The judges submitted it to the secretariat in July 2024. And, only in September of this year, the file was submitted to the Tirana Court of Appeal. At the session on November 14, Appeals Judge Fuat Vjerdha was ill and the case was postponed to December 12.

If the hearings are postponed due to the fault of the prosecution and the court, the detention periods are not suspended.

On December 4, with a sudden decision, Judge Fuat Vjerdha made an interim decision, changing the measure of arrest from prison to house arrest against the two main perpetrators, Ergi Karaj and Orgito Çarçiu, sentenced to 18 and 14 years in prison by the first instance.

The justification was that the power of detention had been lost due to unjustified delays in the investigation and trial.

In the session on December 12, 2024, Fiksi went to the Tirana Court of Appeal, where he participated in the session.

The trial was held behind closed doors because the perpetrators are minors. During the trial, the victim's family members asked the judge for the reason for the acquittal.

The judge reasoned that the detention had lost its validity due to the delays. In the end, the court decided to uphold the decision of the Elbasan Court.

"I wanted them to be sentenced as the letter says, not with a summary trial. I've been on the run for a year and a half. Even now I haven't received justice," Mustafa Bici, the victim's father, told Fiksi./Tch
