The first hearing for the "5D" file, with former Tirana Municipality officials as defendants, has been postponed again at the Special Anti-Corruption Court.

The next session is scheduled for April 30th.

The reason for the postponement of the session was the replacement of Redi Molla's defense lawyer, while another lawyer requested to familiarize himself with the file documents.

In this undisclosed file are the former directors of the Municipality of Tirana, Redi Molla and Mariglen Qato, accused of the criminal offenses of " Passive corruption", "Failure to declare income" and "Money laundering ".

Meanwhile, the other defendants Taulant Tushe, Nestor Muhametllari, Albano Janku, Julian Zanaj and Enton Punavia will be tried for violating equality in tenders.

From the investigations conducted by SPAK, it has been proven and established that the defendant Redi Molla in his capacity as the former General Director of the company "Ujësjës Kanalizime Tirana" at the time when the action was committed, together with Mariglen Qaton in his capacity as the former Director of the Support Department in the company "Ujësjës Kanalizime Tirana" sh.a and the former Chief Inspector of the Inspectorate of Territory Protection in the Municipality of Tirana, were hidden owners of the company "5D Konstruksion".

These defendants have owned this company through other persons as fictitious partners in all acts of registration and operation of this company, who have also had partnerships with these defendants.

SPAK has investigated and proven that "Shoqëria 5D" with hidden owners, defendants Redi Molla and Mariglen Qato, have illegally benefited from 12 public tenders by violating the rules of prosecution and securing monetary benefits of around 192.7 million lekë. The tenders that "Shoqëria 5D" has won, were mainly organized by UKT, the Municipality of Tirana, "Tirana Parking" and "Klubi Sportiv Tirana" being favored by the defendants, who at that time exercised public functions.

The above monetary amounts that constitute the proceeds of the criminal offense were partially withdrawn from the banking system using the fictitious invoice payment scheme and were subsequently deposited back in "cash" form in the company's cash register.

This money, obtained in illegal ways, was used by the hidden owners of this company to purchase assets and finance other commercial activities.

This scheme also includes Taulant Tusha in his capacity as General Director of the Public Works Planning Directorate and member of the Bid Evaluation Committee, as well as the defendants Enton Punavija, Julian Zanaj and Albanon Janku in their capacity as members of the Bid Evaluation Committee, who have created favoritism for the 5D Company and declared them the winner of the procurement procedure in violation of the rules.
