Former Prime Minister Sali Berisha must appear the next day (Monday) before the officer of the Judicial Police, according to the measure left in force by GJKKO, with "compulsion to appear".
According to the decision of the Special Court, for the citizen Sali Berisha, he must appear before the authorities twice a month, on the first and third Monday of the month.
But Berisha himself, in his public appearances, has called the decision unconstitutional, implying that he will not implement it. He claims that as an MP with immunity, his constitutional right to freedom of movement has been violated.
But what happens if Berisha does not appear before SPAK?
It is not excluded the possibility that GJKKO will change the measure, requesting a stronger measure, such as forced escort.
"In case of violation of the obligations related to an insurance measure, the court may decide to replace or combine it with another more severe measure, taking into account the importance, motives and circumstances of the violation. For the violation of the obligations related to a prohibitory measure, the court may decide to replace or combine it with a coercive measure", Article 231 of the Code of Criminal Procedure states.
