Academician Fuga on the new Criminal Code: He silences society. I didn't

Cohabitation with minors is expected to be punishable by up to 16 years in prison. Also, parents who allow it risk up to 10 years in prison.

Risk of being handcuffed even for double marriages. Anyone who drives an unplugged car can also end up in the cell.

Those who impose inappropriate service charges also risk staying behind bars.

Imprisonment if he influences the court with comments or reveals investigative secrets; are some of the innovations proposed for the new Criminal Code.

"In many articles, the state is protected more than the citizen. Of course, the state, the prime minister, the president must be protected. But it must be determined: how does criticism differ from denigration? Otherwise, there is a risk that the entire society will be silenced, the journalist will be silenced, criticism, the opposition or an ordinary citizen will be silenced. I did not see any article protecting the right to be informed. To call criminal offenses those actions that endanger and hinder the journalist, censor the media", says academician Artan Fuga.

The draft amendments to the Criminal Code, currently in the public consultation phase, have been harshly criticized by academician Artan Fuga for unclear wording and the use of metaphorical language that, according to him, contradicts the precision of the law.

"The text is filled with poetic and prosaic metaphors which are not legal concepts and, being such, they can be interpreted as an accordion, as an elastic. This will create endless problems. P.sh. It is said: The desecration of the nation is punished. Anything can be called desecration, even a criticism. Or it is said: the views of a person that make him disgusted by the public. What does that mean? Prolongation of court proceedings, subjectivism," he adds.

Another issue he sees with concern is the punishment of individuals who publish sensitive data, as a violation of freedom of information, under the alibi of "obstruction of justice".

"There are endless anonymous publishers. Today we live in the age of the web. We do not live in the time of the newspaper Zëri i Popullit. Who is the publisher? Media owner? The one who holds the platform? Is it the journalist who bears responsibility? Or all of these? Revealing a secret can hinder justice, but it can also help it, because it is taken as if the journalist is an enemy of justice!", concludes the academician.

Fuga also considers the inconsistency of the required changes with the digital reality problematic.
