"Is Rama criminally implicated by the fact that he knew McGonigal?",
McGonigal and Rama

"The fact that Rama has known the former official McGonigal, does it criminally implicate the Prime Minister?", was this question that Rudina Jasini, researcher and lawyer of International Criminal Law, answered for the show "Opinion".

In her answer, Jasini said that Prime Minister Rama enjoys full immunity as head of state against any criminal prosecution by a foreign state (with the exception of cases of genocide, war crimes and crimes against humanity).

Question: Is Rama criminally implicated by the fact that he knew McGonigal?

Answer - Rudina Jasini, researcher and lawyer of International Criminal Law, Oxford University: Prime Minister Rama enjoys full immunity as Head of State, i.e. as Prime Minister of the Republic of Albania, against any criminal prosecution by a foreign state, (with the exception of cases of genocide, war crimes and crimes against humanity.) Any possible consequences of what may have happened and any involvement that constitutes a violation of the law, both in the USA and in Albania, is related to the political and moral responsibility of Mr. Rama. But this does not exclude possible later responsibility when he is no longer the Head of State.

It is the prerogative of the Prosecution to determine on the basis of evidence, evidence and available information who will be the subject of an indictment. This does not mean that individuals involved in this "affair" will not be the subject of further investigation at a later point, if the transaction took place on US territory, or if there were US citizens involved. But this depends entirely on the material basis and information that the prosecutor's office has and who it considers a priority to prosecute.
