5 thousand euros for the release of a prisoner, SPAK closes the investigations

The Special Prosecutor's Office against Corruption and Organized Crime in Tirana has completed the preliminary investigations and submitted to the Special Court of First Instance for Corruption and Organized Crime the request for trial of criminal proceedings No. 07 of 2023, in charge of the defendants:

1. Arben Lena, accused of committing the criminal offense of "Exercising illegal influence on persons exercising public functions", carried out in cooperation, provided for by article 245/1/4-25 of the Criminal Code, Chairman of the Korça Bar Association;

2. Nikolla Hafësllari, accused of committing the criminal offense of "Exercising illegal influence on persons exercising public functions", committed in cooperation, provided for by article 245/1/2-25, of the Criminal Code;

3. Nikolla Jesku, accused of committing the criminal offense "Exercising illegal influence on persons exercising public functions", carried out in cooperation, provided for by article 245/1/2-25, of the Criminal Code;

4. Dajana Kodra (Ninga), accused of committing the criminal offense of "Exercising illegal influence on persons exercising public functions", committed in collaboration, provided for by Article 245/1/4-25 of the Criminal Code, lawyer at the Chamber of the Korça Advocacy;

5. Dritan Tabaku, accused of committing the criminal offense of "Discrediting the crime", provided for by Article 300 of the Criminal Code;

6. Blerand Kozici, accused of committing the criminal offense of "Exercising illegal influence on persons exercising public functions", committed in cooperation, provided for by article 245/1/2-25, of the Criminal Code;

7. Artiana Kozici, accused of committing the criminal offense "Exercising illegal influence on persons exercising public functions", carried out in collaboration, provided for by Article 245/1/2-25, of the Criminal Code.

From the analysis of the evidence and data collected in the function of the investigation of this criminal proceeding, it is proven that the defendants Nikolla Hafësllari, Nikolla Jesku, Blerand Kozici and Artiana Kozici in cooperation with each other, have committed the criminal offense "Exercise of illegal influence on persons exercising public functions", provided by article 245/1/2 - 25, of the Criminal Code, in the active form, of giving an irregular benefit of 5,000 Euros, in order to exercise illegal influence on the judge of the Korçë Court of Appeal and the easing of the procedural position of the defendant Blerand Kozici, who was being investigated under the effect of the security measure "arrest in prison", by the Prosecutor's Office of the Pogradec Judicial District (for the criminal offense "Assisting in the illegal crossing of borders ”, provided by article 298/3 of the Criminal Code).

The defendants Arben Lena and Dajana Kodra (Ninga), have consumed the elements of the criminal offense "Exercising illegal influence on persons exercising public functions", carried out in cooperation, provided by article 245/1/4-25, of the Criminal Code, in the passive form of receiving irregular benefits, promising to exert illegal influence on the judge of the Court of Appeal Korçë, in order to facilitate the procedural position of the investigated Blerand Kozici.
