The presidency clarifies why it did not wait for Beler's animation to
President Bajram Begaj

The Presidency has explained why the 30-day deadline that Fredi Beleri has to appeal the decision of the CEC, on the removal of the mandate, was not expected before decreeing the new elections in Himara.

In an answer to "Top Neës", the Presidency says that as determined by the Albanian legal system, in case of vacancies, the President of the Republic is put in motion after the announcement and has 48 hours to act.

The presidency also clarifies that decreeing the date of new elections does not prevent Beler from challenging the decision by requesting his right to the relevant institutions.

Begaj decreed August 4 as the day of holding new elections for the Municipality of Himara.

Full clarification of the Presidency:

The President of the Republic set the date of the elections after being officially notified of the created vacancy. The President of the Republic is not the body that determines the vacancy, as it does not take into consideration the procedure that preceded it, nor is it an instance of administrative appeal.

The President is put in motion by notification. In the Albanian legal system, there is only one legal way to move the President of the Republic, in the case of vacancies in the local government. This route is the route of notification by the Council of Ministers.

The President has only 48 hours to consider the case.

By-elections are held according to a strict legal calendar. Legal deadlines are binding.

The procedure for setting the election date and the procedure for appealing administrative acts are both legal and coexist with each other. If conflicts arise between them, then it is the competent court that has the power to resolve the conflict.

The legal means for the protection of legal interests are not abolished by the procedure of decreeing the elections.
