The EU Energy Ministerial has decided to punish the Albanian government by issuing a decision on December 18 to disqualify Albania ; regarding the tasks that the Albanian government had pledged to carry out in the energy sector.

The decision states that the Albanian government must report during 2026 on what steps it will take to correct the problems identified in energy policies.

Currently, Energy Minister Belinda Balluku is under indictment; while a confidential source told Hashtag.al that this strong decision comes after three projects in which Balluku is personally invested:

1. Roskovec TPP , where a Russian corporation is suspected of being an investor

2. ⁠Energy Ships “ Tigrat ” in Vlora

3.⁠ Destabilization of European interconnection lines due to corrupt deals.

Decision of the Ministerial Council of the Energy Community

2025/03/MC-EnC – Non-compliance of Albania with the Energy Community Treaty (Case ECS-5/24)

The Ministerial Council of the Energy Community notes that:

Article 1 – Non-compliance by Albania

Albania has failed to adopt and implement, by 31 December 2023, the legislation, regulations and administrative acts necessary to comply with:

–Directive ( EU ) 2019/944 (internal electricity market),

–Regulation ( EU ) 2019/941 (risk preparedness in the energy sector),

–Regulations ( EU ) 2019/942 and 2019/943,

as well as a series of EU technical regulations on:

–capacity allocation,

–congestion management,

–energy balance,

–emergencies and transmission system operation.

Also, Albania has not notified the Secretariat of the relevant measures, violating:

–Energy Community decisions of 2021 and 2022,

–as well as Articles 6 and 89 of the Energy Community Treaty.

Article 2 – Follow-up actions

1. Albania shall immediately take all necessary measures to remedy the breach and comply with Energy Community law.

2. Albania should report regularly during 2026 on the measures taken.

3. If the breach is not corrected by 1 July 2026, the Secretariat is invited to initiate sanctions proceedings under Article 92 of the Treaty.

Article 3 – Entry into force

The decision is addressed to the parties and institutions of the Treaty and enters into force immediately upon adoption.
