Arben Ahmetaj

On September 28, in an informal meeting with journalists, the head of SPAK, Altin Dumani , announced surprising developments in the direction of the former deputy prime minister,  Arben Ahmetaj .

The latter has been declared wanted for the case of incinerators , but this file is not his only trouble with justice .

This Sunday has started briskly with information about Ahmetaj , who has been charged for the second time by SPAK , this time for the privatization of the former bread factory, at the time when he was in charge of the Ministry of Economy .

Prosecutor Elvin Gokaj was the one who took Ahmetaj as a defendant for the charge of " misuse of duty ", while the damage that is calculated is around 700 million new ALL.

Investigations continue in the direction of the businessman Lirim Fezollari, who has already built the Emerald shopping center on the land where the former bread factory used to be. The property in question belonged to the Myderizi family.

Despite the fact that the property conflict was moved to several levels of the Judiciary, Ahmetaj and some of his subordinates had paved the way for the privatization of the former factory by Fezollari, while the position of the socialist is aggravated because there was also a joint trip with the businessman to one of the EU states, which indicates personal acquaintance between them.

What happened with the privatization of the former bread factory?

In July 1995, a decision of the Property Restitution and Compensation Commission (KPPP), clarified by a court decision of that time, recognized an old Tirana family as the owner of an area of 8980 m2 in the area of "5 May ", of which 4890 m2 was the building of the state factory of Buka.

Two months later, in October 1995 , the anonymous commercial company "Buka" sha was registered, in absolute ownership of the Albanian state, through the Ministry of Finance. Part of the assets of this company was the land, which was known to the Tirana family. In 1996, the Ministry of Finance decided to sell 49 percent of its shares, continuing to maintain control over the company "Buka" sha.

In 2000 , the Ministry of Finance calculated the quotas due to the former owners in the company "Buka" sha. For the former owners of the land of this company, a value of 8.8 million new ALL has been awarded, which corresponds to a package of 3.1 percent of the shares. In 2004, the Ministry of Economy decided to sell its shares in the company "Buka" sha, at the figure of 47.65 percent.

The heirs of the land have objected in court, both the value of the quotas determined by the Ministry of Economy, as well as the auction procedure, until the amount of shares in "Buka" sha is finally clarified. Among other things, the decision of the Ministry of Economy regarding the minimum number of quotas deprived them of the right not only to a fair evaluation, but also to be included in the auction with the right of pre-emption of government shares.

Their request was accepted by the Court of Appeal in 2006 and the Ministry of Economy was forced by the court to cancel the auction, as well as to assess the heirs of the owner with the market value. The Ministry of Economy canceled the auction procedure, but for years did not implement the part of the decision on the re-calculation of the shares of the heirs and their evaluation.

In 2014 , the then Minister of Economy, Arben Ahmetaj, again announced the auction for the sale of 47.6 percent of the state shares in "Buka" sha. Here is the moment when businessman Lirim Fezollari appears. In September 2014, he had initially bought a 15 percent stake. Within three months, until November 2014, Fezollari manages to buy 40 percent of the shares from the multitude of minority partners (mostly former employees of "Buka sha").

So, at the time of the announcement of the auction, Lirim Fezollari was effectively the second largest shareholder of "Buka" sha, after the Ministry of Economy. However, this situation of the shareholders did not reflect the decision of the Court of Appeal in 2006, which required the re-evaluation of the quotas in the society of the heirs of the land, where the buildings of "Buka" sha were located.

In September 2014 , Ahmetaj announced the auction procedures for the sale of government shares in "Buka" sha., while the final decision, taken by the Court of Appeal in 2006, for the re-calculation of quotas of the former owners in "Buka" sha. In June 2015, the Auction Commission, set up under the Ministry of Finance, which at that time was headed by Shkëlqim Cani, signed a preliminary agreement with the businessman Lirim Fezollari, where the modalities of the procedure are defined.

In August 2015 , the Ministry of Finance announced the businessman Fezollari as the winner of the auction for the purchase of shares (and therefore assets) of the anonymous company "Buka" sha.

While these procedures were taking place, the heirs of the former owner turned to the court again, where they requested the cancellation of the newly announced auction, as well as the revaluation of the property with the determined prices, according to a decision of the Constitutional Court of 2001 and its subsequent acts.

The Ministry of Finance was impatient to close the auction, while the institution was sued in court and the court process was ongoing. In October 2015, just two months after the announcement of the results of the auction, the Administrative Court of the First Instance gave the right to the former owners, also deciding to cancel the consequences of the procedure.

The case goes to Appeal , with the Ministry of Economy as the appellant, as the institution that ordered the auction. While the case was awaiting the decision in the Appeal, it turns out that the businessman Lirim Fezollari, as the majority shareholder of "Buka" sha, sells the assets of the company, specifically its land, to the company "Tobbaco Holding", which was also owned by it.

In November 2017 , the Administrative Court of Appeal finally gave the right to the former owners, both for the cancellation of the auction and for the reassessment of the quotas in the company "Buka" sha.

Former minister Arben Ahmetaj  continues to be a deputy, but from August 24, 2023, the administration of the Assembly has stopped the salary and support services that come due to the duty, such as payment for the telephone, vehicle, fuel and housing expenses.

Ahmetaj left Albania before the arrest warrant was signed and his whereabouts are still unknown.

He has been declared internationally wanted since July 24, 2023, as he is accused of " non-declaration, false declaration and concealment of wealth ", alone and in cooperation, " Passive corruption of high state officials or local elected officials " in six cases, " Cleaning of the products of the criminal offense or criminal activity ".

SPAK's investigations were launched based on the report of the heirs of the former owner, the Myderizi family, who have acquired the right to return the land, where the electric oven of "Buka" sha was previously located, in the area of "5 Majit" in Tirana.
