After non-bank financial institutions collecting bad loans, the Bank of Albania has imposed drastic supervisory measures also in the segment of Savings Credit companies.
This month, the Bank of Albania has ordered the suspension of the activity of SHKKs "Perlat" and "Rrushkull One".
Based on the report of the examination of the activity of the Savings-Credit Company "Rrushkull One" for the period July 31, 2021 - December 31, 2023, the group of inspectors of the Supervision Department has determined a number of problems and deficiencies, which constitute a violation of the requirements of law no. 52/2016 "On savings and credit companies and their unions", as well as the regulations issued by the Bank of Albania in implementation of this law.
Based on the very long list of detected violations, the Bank of Albania has suspended the exercise of financial activities for which it is licensed for a period of 6 months (January 31, 2025). During the period of suspension, SHKK "Rrushkull One" cannot exercise lending activity, and it is not allowed to collect deposits in any form, including current account deposits.
During the suspension period, only the withdrawal of deposits and the repayment of loan installments by members of SKK, as well as the transfer of deposits and loans for the purposes of the absorption merger with SKK "Perlat" are allowed.
In addition, the Bank of Albania has also ordered the limitation of the growth of financial assets, including off-balance sheet items with risk during the period of suspension of the exercise of financial activities for a period of 6 months (until January 31, 2025) and the prohibition of the increase of exposure to a member or third party for a 6-month period and the prohibition of making any type of investment for the same period.
Meanwhile, the problem of the other SHKK, "Perlat", has its origin as early as 2018, when after communications with the Bank of Albania, the entity was asked to voluntarily liquidate the company. In March 2018, SHKK "Perlat" announced that it would support the creation of a new company, which would also absorb SHKK "Perlat" (Decision of the Assembly dated 28.3.2018).
In 2021, the Bank of Albania has licensed SHKK "Rrushkull One", which has joined the deposit insurance scheme in August 2021. In the business plan presented by SHKK "Rrushkull One" at the time of licensing, it is also foreseen the process of merging with SHKK "Perlat", where SHKK "Rrushkull One" would be the absorbing company). For more than three years, this process has not been carried out.
Under these conditions, the Bank of Albania has decided to suspend the activity of lending and collecting new deposits in any form from its members, SHKK "Perlat" until December 31, 2024. During the suspension period, only the withdrawal of deposits at the request of members, the repayment of loan installments by the members of SKK and the transfer of deposits and loans for the purpose of merger by absorption with SKK "Rrushkull One".
During the suspension period, SHKK "Perlat" must take all necessary measures and decisions to finalize the merger by absorption with SHKK "Rrushkull One".
Since 2017, deposits with SCKs are insured up to the value of two million ALL. However, the insurance becomes effective only when the respective SKK becomes a member of the insurance scheme of the Deposit Insurance Agency.
For this purpose, KSCs must be certified and receive a certificate of fulfillment of the criteria from the ASD Governing Council. However, some of the SCS have not yet joined the deposit insurance scheme, according to legal requirements.
According to the Bank of Albania, there are currently 16 licensed SHKKs in Albania, but five of them have suspended their activity in the period 2015-2016. Based on official information, there are 11 active KSKs (including the two KSKs suspended this month), but the Deposit Insurance Agency reports only nine entities that are members of the deposit insurance scheme.
