It is not just imprisonment that is the problem of today's criminal justice.

Of course, I feel good that finally today there are others and even officials who acknowledge this problem, which I have been saying officially and publicly for at least 10 years.

But today, the pitfalls dug in what is called the due process are numerous.

From the registration of the criminal proceeding with anonymity, political and popular informants, and until its final decision, there is very little chance of not stepping on a landmine.

At the end of the process, even if you are far from innocent, you still come out severely crippled.

All of this is mostly due to the lack of an impartial court. That is, a court that judges the parties in the courtroom.

A court where the prosecutor and the defendant have the same means and opportunities. Neither should be favored over the other.

Look, today the admissibility of prosecution requests is approximately 80%. The GJKKO has over 90%.... In the West that we like to refer to, when this figure exceeds 40%, concern arises.

This high level of admissibility of the requests of one party, namely the prosecution, also defeats the very definition of the term trial. There is no trial when one party is always right.

When there is no trial, the court has no meaning anymore.

Why is this happening?

Clearly for two fundamental reasons:

1. The communist state and its mentality still live in our collective memory. In that state, only the prosecutors were known. Although the judges were elected, no one knew them, because they decided what the prosecutor said. If someone decides to return to that time, public acceptance and likeability remain high.

2. By law, and in practice, prosecutors blackmail judges in the name of protection from corruption. This legal and practical reality has exhausted judges who do not even bother to listen to the other side.

With these courts and in this reality, especially after the reform, people are detained, tried, and sentenced based on assumptions and conjectures.

Legal notions of evidence and provability are at the lowest level we have ever had, even compared to the communist system itself.

The latter had problems with the quality of the evidence but not with its existence in the courtroom at least.

Equality before the law and the means of trial are in total imbalance. An imbalance in favor of the "close minded" prosecution.

The fundamental freedoms and rights provided for in the Constitution are always secondary in criminal proceedings.

There are few who have the "privilege" of having their freedoms judged in constitutional trials. Even fewer have the "ability" to win back the freedoms or rights that have been violated.

And so on, the bottomless minefield has a process that produces mutilated victims, who are served to "privileged" journalists as news sources for popular justice.

The popular trial is the last act of pressure on the court, in the entire chain of control of the court's decision-making.
The latter judges, in many cases, about your rights without your presence in a courtroom!!!
So I say that solving the problem of imprisonment is no longer enough.

We need a complete reform!

We don't have to wait for the Council of Europe or any embassy to tell us this. When the time comes, they will tell us too, it's too late....

We just need eyes in our foreheads and minds in our heads.
