Politics tries to win votes by mentioning justice, reform, its failures and achievements.
But if we think a little more coldly and stripped of political influence, we will understand that it is justice itself that has made a hole in the reform.
The latter, by going to extremes and completely illogically with the detention of people, as part of the popular war where "man eats man", has seriously and very seriously destroyed the constitutional and legal order in the country.
I want to repeat what I have been saying for years: the extreme application of the security measure of imprisonment is not based on the proportionality provided for in written laws.
This extremism has come about simply due to the individual protagonism of SPAK prosecutors, protagonism which was mostly encouraged by Mr. Altin Dumani during the years of his leadership.
Nothing personal in this observation, but the facts must be coldly stated as they are.
Detaining people in the early stages of investigation, with the exception of receiving applause from the excited crowds for blood and, no, praise from foreign officials (to our shame and black face), has led to the destruction of justice. It has even destroyed the investigations themselves, because when you throw the irons on someone else, you don't let them investigate anymore. No normal manual suggests what SPAK is doing.
The pressure of prison-prison-prison has seriously and very seriously compromised the court and the very concept of trial.
Today's courts meet secretly in closed rooms and make decisions about you, your life, your freedom, your property and your rights. You find out about the secret decisions when the police communicate with you. So you are not even a party when the decision is made for you!!!
Even when you become a party, the courts still decide for you not by listening to you, but by reading you. The right to be heard in a courtroom has ended.
Courts intimidated by Spak's pressure/wiretapping do not dare to hold a trial, but rather legalize what the prosecutor brings to them. Where has it been seen or heard, in a country with an impartial court, that the prosecutor of the case wiretaps the judge of that case?!
Criminal investigation and trial based solely on words, thoughts, and opinions is light years away from a fair trial based on habeas corpus.
This was neither ordered by politics nor by law, but simply dictated by individual protagonism.
I am, of course, critical of the rubber-band laws we have in force. These laws should be overturned, but the fact is that extremism in their implementation has damaged fair and constitutional justice, activating popular justice as a means of punishment.
This is not justice!
Extremism is not justice, but revenge.
In this sense, the new leader of SPAK should be selected no longer for protagonism, but for legal normality. Not to please America (because they opened our stomachs), but for constitutional and legal Albania.
