The Supreme Court reacted to Ervin Salianjit's accusations regarding the short assignment of the rapporteur who will review the recourse of the former Democratic MP, who since September 26, 2024 is serving a 1-year sentence of freedom, in Fier Prison.

The lot initially appointed Judge Albana Boxing but then the case was passed to Sokol Binaj.

The Supreme Court clarifies that Binaj had also been the rapporteur of the appeal by Salianji regarding the suspension of the execution of the Court of Appeals decision, which was dismissed and under the law there cannot be two different judges as rapporteur.

Ervin Salianji labels the entire process for him as political, while warning that those who took him behind bars will be held accountable.

On 08.01.2025, the criminal case was registered in the High Court with the number 51180-00012-00-2025, which has as its requesting parties: the Prosecution office at the Tirana District Court and defendants: A.V., F.A., J.O., E.S., and G.(A.)J.J.

Through electronic registration in the Litigation Management System (ICMIS), which is not administered by the High Court but by the High Judicial Council, the draw automatically appoints a judge relating to each registered case. For this matter he is assigned via electronic lot as relator judge, member of the Penal College, Albana Boxing.

Based on Order No. The courts have decided to consider the decision of the President of the High Court no. 106, dated 15.05.2023 of the Chancellor of the High Court "On some organizational measures related to the management of judicial matters", it is obligatory that "when for reviewing the request for suspension of the execution of the previously registered civil/administrative/criminal decision and for review of the recourse registered later, two different relational judges from the ICMIS system are appointed, the court case shall be passed on behalf of the judge appointed for reviewing the suspension of the execution of the civil/administrative/criminal decision.

Referring to this order and in order to respect the compliance with the practice that has been followed in all cases of this nature, the decision was made to transfer the case for review of the recourse to Judge Sokol Binaj, who is the judge who has previously reviewed the request for suspension of the execution of the award, registered with the number 77303-00022-00-2024, dated 01.10.2024.

Failure to fulfil such an action would be considered contrary to the rules established for the natural judge and to the standard of the court set by law.

This action, which is carried out automatically by the electronic system, which also guarantees its integrity, aims to ensure better and faster management of judicial cases, as well as transparency and efficiency in the administration of justice.
