Innovations from the PENAL CODE/ BE CAREFUL, abandoning and abusing animals can

Abandoning a dog, cat, or any other animal can land you behind bars.

This is one of the innovations of the new draft of the Criminal Code, which was presented in recent days in Tirana and is currently in the public consultation phase.

The draft law includes for the first time a separate chapter on animal protection and toughens penalties for any form of abuse, mistreatment or abandonment.

According to Article 944, abandoning an animal, if it endangers its life or health, is considered a criminal offense and is punishable by a fine or imprisonment of up to three years.

The same amount of prison time is also provided for in Article 943 for cases where an animal is seriously harmed or caused pain through brutal acts, including acts of a sexual nature.

If the mistreatment results in the death of the animal, the penalty is increased by 50%.

The new draft does not exempt owners who do not keep animals under control in public spaces from punishment.

If an animal, due to lack of control or a protective mask, causes injury to a person, the owner risks a fine of up to 6 months in prison.

In more serious cases, when the injury is profound or has fatal consequences, the punishment increases significantly.

Another point is the prohibition of organizing matches between animals in Article 946 of the Code.

Organizers, promoters, or even those who place bets on these matches can be sentenced to between several months and 6 months in prison.

This article maintains the same punitive measures as the current Code adopted in 19995, but has been brought back into focus due to previous cases. The penalties are significantly increased if the criminal offenses are committed with cruelty, for profit, in the presence of children or during public events.

In all these cases, the penalty can be increased by up to 50%.

The draft of the new Criminal Code is still under discussion and is expected to be passed by Parliament after the completion of the public consultation process.
