The Supreme Court clarified the reasons for rejecting the request of the former Prosecutor General, Adriatik Llalla, to suspend the 2-year prison sentence.
The former General Prosecutor sought to delay his going to jail, while the sentence against him in the Appeal for "concealment of non-declaration of wealth" that led him to jail, was announced a few days after he had left the country. In the reasoned decision, provided by A2 CNN , the Criminal College considers the claim of the former chief prosecutor to be unfounded, that his life in the cell is at risk due to health problems.
"This disease can be cured and followed by specialist doctors even under the conditions of staying in an institution for the execution of criminal decisions, without endangering the applicant's life. The fact that the applicant has been suffering from this disease since 2009, as presented in the medical-legal assessment, proves that this disease can be cured and kept under control by the subject even while he is serving the punishment assigned to him".
Even Llalla's claim that he is the father of three children, one of whom is a minor, has not been seen as a contributing factor by the Penal College, which goes further, describing the former chief prosecutor as socially dangerous.
"The panel assesses that referring to the procedural situation of the applicant, the fact that he did not fulfill the obligation for the voluntary execution of the criminal decision, but left, making the execution of the sentence impossible, until he was arrested by the Italian justice authorities, prove not only the dangerous social status of the applicant, but also the possibility of repeating this behavior in the future".
In the same decision, the Supreme Court multiplied by zero the claim of Adriatik Llalla to take into account the fact that he exercised high functions in constitutional institutions. Adriatik Llalla was arrested in Italy in December last year pursuant to the arrest warrant issued against him. He was released in less than 24 hours, due to health reasons, being left under a measure of "prohibition of leaving the country", while the Albanian judiciary has sent a request to Italy for his extradition.
