The Constitutional Court will decide today on Rama's appeal against Belinda
Belinda Balluku and Edi Rama

The Constitutional Court's judicial body will meet this Tuesday to make a decision regarding Prime Minister Edi Rama's appeal against the suspension from office of Deputy Prime Minister and Minister of Infrastructure, Belinda Balluku.

The hearing is expected to be long, with the judges giving their positions and arguments, followed by a vote.

The decision is expected to be announced today, while the 8 judges will also clarify whether there was judicial interference in the executive and whether a minister enjoys the legal immunity of a deputy.

This is the first case where a minister has been suspended from office following a request from SPAK, placing the issue at the center of public and legal attention.

On January 22, the Constitutional Court reviewed Prime Minister Edi Rama's appeal regarding the decision to suspend Balluk. The government is asking the Court to interpret Article 103 of the Constitution, according to which members of the government enjoy parliamentary immunity, and to decide whether the Special Court can suspend a minister without authorization from the Prime Minister.

Two SPAK prosecutors, Dritan Prençi and Dorina Bejko, rejected the government's claims, stating that there is no conflict of powers between the powers and that the suspension of a minister is not the competence of the Prime Minister.

The Constitutional Court's decision comes at a time when SPAK has submitted to the Parliament a request for authorization to arrest Balluk, placing the issue at the center of legal and political debates in the country.
