Convicted of prostitution, GJKKO Appeal upholds the confiscation of the assets

The appeal of GJKKO has upheld the confiscation of the assets of OFL subject Çlirim Mark and his family members

Mark is subject to the OFL, while the Special Court of Appeal for Corruption and Organized Crime upheld SPAK's request, while his assets have passed to the state.

The Special Court of Appeal for Corruption and Organized Crime, with a panel composed of judges Nertina Kosova (presiding), Saida Dollani (member) and Igerta Hysi (member), today on 04.04.2023, announced the decision regarding the case of registered with no. 1/75 act, date 12.04.2022 registration, on the appeal presented by the appellants Ç.M., EM, KM, NM, against decision no. 36/140, dated 11.02.2022 of the Special Court of First Instance for Corruption and Organized Crime, which decided:

"1. Accepting the request of the Special Prosecution Against Corruption and Organized Crime.

2. The confiscation and transfer in favor of the state of the assets as follows:

· Real estate no. {...}, cadastral area {...}, volume {...}, page {...} of land type with an area of ​​206 m2, as well as a 3-storey residential building + attic legalized with the legalization permit no. {...} dt. {...} happened in {...}.

· Real estate no. {...}, cadastral area {...}, volume {...}, page {...} of apartment type with an area of ​​93.4 m2, located in {...}.

· Real estate no. {...}, cadastral area {...}, volume {...}, site {...} of apartment type with an area of ​​107.8 m2 located in {...}.

· The rights that the subject of the normative act {...} has acquired in the capacity of the buyer with the sales promise contract no. {...} rep. no. {...} col. date {...} on the apartment-type real estate with a total area of ​​64.08 m2, located in the neighborhood {...}.

3. The removal of the measure of seizure for the real estate of the apartment type with a total area of ​​64.08 m2, located in the neighborhood {...}, benefited by the contract promise - sale no. {...} rep. no. {...} col. date {...} as well as for the movable property Mercedez Benz model ML 320 vehicle, with license plates {...} seized by decision no. 62 dt. 15.01.2021 of the Special Court of First Instance for Corruption and Organized Crime...".

In conclusion, the Special Court of Appeal for Corruption and Organized Crime decided:

- Enforcing decision no. 36/140, dated 11.02.2022 of the First Instance Special Court for Corruption and Organized Crime.
