Reporting on the work for 2024 at the KLP, the head of SPAK, Altin Dumani, also spoke about the issue of the status of SPAK prosecutors and what will happen to them after the end of the 9-year term.

Dumani said that he was in favor of re-nomination of every SPAK prosecutor after the end of this mandate, while emphasizing that being in favor of this option does not mean that he is in favor of automatic renewal of the mandate.

"We discuss the issue of the status and fate of prosecutors together with my colleagues. I have never declared or proposed any change without consulting all prosecutors and we have moved towards a unanimous opinion of all. We have proposed non-automatic renewal of the mandate, which means that at the end of the 9-year term, the prosecutor is not automatically reappointed without competition. The proposal is to make a constitutional change, so that prosecutors at the end of the mandate are given the opportunity to re-apply, which means to re-apply with other prosecutors. This also makes the continuity of the institution possible. Of course, for those who want to continue, while normally there will also be those who do not want to continue further."

He said that at the end of the 9-year mandate, if the prosecutor wishes to run for re-election, he would be under the filter of the Council, which, looking at the work of this prosecutor, could re-appoint him or not, based on his performance.

"And it is a good opportunity for SPAK prosecutors, at the end of their mandate, to re-apply, but to be told: 'Thank you for these nine years, but we as the Council tell you that your performance is not such that we should renew the contract again to continue working at SPAK'. While the second option, as you said, is for the prosecutors of the Special Prosecution Office to have the opportunity, at the end of the 9-year mandate, to be attached to the Appellate Prosecution Office. I am for the first option: that SPAK prosecutors, at the end of the 9-year mandate, be given the opportunity to re-apply for a new mandate, but I emphasize: not to be re-appointed. We are against automatic reappointment and in favor of re-appointment", said Dumani
