DPSHTRR withdraws from the decision to double the patent price: It was a

DPSHTRR has described the decision to double the price of the patent that was banned by the Competition Authority as 'referential, not decisive'.

Notification:

DPSHTRR, following the press release made by the Competition Authority, clarifies the position, first by expressing cooperation, in implementation of Law 9121, dated 28.07.2003 "On the protection of competition", as amended, that the object of the "Act of Agreement ” between DPT, Associations of Driving Schools and DPSHTRR, is “Recognition between the Parties, with the payment fee, as well as the assessment of the minimum fiscal reference cost, for the fulfillment of the education program for the preparation for drivers and the equipment with the driving license categories: AM, A1, A2, A, B1, B, BE, C1, C, C1E, CE, D1, D, D1E, DE; for the preparation for regaining the driving license after the total loss of points or for its removal, as well as the preparation for the equipment with the evidence and certificates of professional training". and not the determination of the payment fee and the minimum fiscal cost for the preparation and equipment of the driver's license. We clarify once again that the fee and cost are referential and not determinative, to guarantee the mandatory implementation of equal conditions in teaching.

The content of the cooperation agreement is conceived as a specific legal obligation, arising from the provisions of instruction no. 9, dated 14.02.2022, "On the activity of driving schools" and the obligation to complete the training program (in full compliance with European directives) for training on obtaining a Driving License.

Legal basis:

1.1 Law No. 8378, dated 22.07.1998 "Road Code of the Republic of Albania", amended;

1.2 Law No. 10081, dated 23.02.2009 "On licenses, authorizations and permits in the Republic of Albania", amended;

1.3 Law no. 9920, dated 19.5.2008 "On Tax Procedures in the Republic of Albania", amended, as well as the Instructions of the Ministry of Finance in its implementation;

1.4 Law no. 8438, dated 28.12.1998 "On income tax", as amended, as well as the Instructions of the Ministry of Finance in its implementation;

1.5 Ligjit nr. 92/2014 “Për tatimin mbi vlerën e shtuar në Republikën e Shqipërisë”, i ndyshuar, si dhe Udhëzimet e MF në zbatim të tij;

1.6 Ligjit nr. 87/2019 “Për faturën dhe sistemin e monitorimit të qarkullimit”, i ndryshuar, si dhe Udhëzimet e MF në zbatim të tij;

DPSHTRR stands by the position of taking and exercising legal responsibilities, congratulating DPT for the will and institutional cooperation, to face and not hide, to try, not choosing populist or hypocritical approaches!

The challenge of road safety standards exceeds any hesitating and complex bureaucratic attitude! DPSHTRR continues steadfastly the work to reform the Driving Education sector, a main component of Albanian Motorization, of vital importance for public safety and society.

The supervision of this sector remains an institutional challenge at the level of administrative and fiscal control!
