Beler's sentence, GJKKO clears up the decision: The wiretapping that
Fred Beller

The Special Court has revealed the reasoned decision by which it closed Alfred Beler behind bars for 2 years, as guilty of "corruption in elections".

In the 90-page decision, the three judges reason that Alfred Beleri and his co-defendant Pandeli Kokaveshi have committed the criminal offense between illegal actions in two forms, by offering and giving money to the elector, or to other persons of related to him, in order for him to vote in a certain way.

WIRETAPPING

According to the court, it was proven beyond any reasonable doubt that Dhionisis Alfred Beleri offered Arsen Rama the monetary sum of 50 euros for each person who would find him as his voter for mayor of Himara and for the service a reward of 300 euros .

Among the evaluated evidence is this environmental interception, where Alfred Beleri tells the infiltrator "I'll give you, I'll give... from 50 euros. Hour! ” and after receiving a “yes” from the interlocutor adds “yes, they saw in the box that you also have 300 euros”.

According to the court, Beleri gave the sum of 40,000 ALL for 8 votes to Arsen Rama through the other defendant Pandeli Kokaveshi, who was put on 3 years of probation.

Rejecting Beller's Defense Arguments

In the reasoned decision, the court rejects all claims raised by Beler's defense for violation of the procedure by SPAK.

The court considers as baseless the claims made by the lawyers about the wiretapping, or even the fact that Arsen Rama was not in Himare on the day when he was wiretapped with Alfred Beleri and received the amount of money from Pandeli Kokaveshi, overturning two of the strongest arguments of the defense .

"The court appreciates that the taking of evidence and their recording in the procedural documents was carried out in full compliance with the law. The evidence presented by the prosecution body is not suspicious, unconfirmed and contradictory, but they are linked in sync with each other", the decision said.

The lawyers claimed that Arsen Rama, the police infiltrator, was not in the territory of Himara, when it is claimed that he had meetings with Fredi Beleri, meetings during which audio and video were recorded, as well as photographs were taken. The defenders raised this claim based on the analysis of phone records.

But the court in its decision states that: "Regarding the claims of the defendant Dhionisios Alfred Beleri, that the citizen Arsen Rama was not in the city of Himara on May 10, 11, 12 when the meetings with the defendants Beleri and Kokaveshi took place, the court assesses that this claim is unsupported by evidence".

"Referring to the tabular data of the number in use of the citizen Arsen Rama, it results that in the meetings held with the defendants, namely on May 10, 2023 from 08:40 to 08:48, from 20:20 to 20 :24 citizen Arsen Rama is registered in the territory of Himara and not in any other city", the court reasons.

Focusing on the audio and video recording of the conversations between the defendants and the police infiltrator, the court reasons that the lawyers have not raised any claims about their content and have not requested to listen to the conversations at the hearing.

As for the claims related to the review of film footage, photographs, the re-recording of the interception actions alleged to have been carried out in violation of the law, the court assesses that this claim is not unfounded in the law.

"In any case, even during the trial on the merits, the parties can listen to the interceptions for which they have claims in the court session. The defenders of the defendants, asked by the court at the hearing of the review of the written evidence, if they had any claims on the content of the interceptions and if they wanted to listen to the audio-video material, stated that they have no claims on the content and did not want to listen to this material ", he emphasizes. judicial bodies.
