The Ombudsman Institution has raised the alarm over the massive use of pre-trial detention in Albania , highlighting that the criminal justice system is facing overload and continuous violations of the rights of persons deprived of liberty.
According to the 2025 Annual Report , over half of the country's prison population is in pre-trial detention, without a final court decision.
The report highlights that 56.8% of people in prisons are pre-trial detainees, a level that is 27.8% above the average for European Union countries.
According to the institution's analysis, this indicates limited use of alternative security measures and an excessive reliance on prison arrest.
The Ombudsman notes that this situation has led to overcrowding in prisons, deterioration of living conditions, and a weakening of the rehabilitation function of the penitentiary system.
The institution highlights that the problems begin in the early stages of detention, where documentation of police actions, respect for procedural guarantees, and access to legal protection are " not uniformly guaranteed ."
The report also highlights that the judicial system continues to suffer from a shortage of judges and procedural delays.
Currently, courts are operating with about 66% of the projected number of judges, which according to the Ombudsman leads to frequent postponements of hearings and delays in processes.
The report also raises concerns about overcrowding in prisons.
Lezha Prison, according to published data, has exceeded capacity by about 65%, reflecting high pressure on the penitentiary system.
In conclusion, the Ombudsman calls for the strengthening of institutional control mechanisms, wider use of alternative measures to detention, and urgent intervention to avoid repeated human rights violations in the criminal justice system.
